Gaps in legal system kept suspect in three killings on the streets

He was in this country illegally. Ten months ago he was charged with assaulting bar patrons; last month he was indicted for sexually assaulting a young girl and threatening to kill her family.

But Jose Lachira Carranza was not in jail awaiting trial, or in de tention as an illegal immigrant. He was free to roam the schoolyards of Newark, where authorities say he took part in the murder of three college-bound students and the shooting of a fourth last Saturday night.

As Carranza was arraigned yesterday on murder, weapons and other charges -- and ordered held on $1 million bail -- authorities in Essex County faced tough questions about why a man who should not have been in the United States, and was accused of a seri ous crime, had remained on the streets.

Court records and statements by prosecutors, immigration authorities and legal experts show how routine bail procedures and wide gaps between law enforcement and immigration policy worked in Carranza's favor in the months before the killings behind Mount Vernon School.

At a news conference following yesterday's arraignment, Essex County Prosecutor Paula Dow declined to comment on whether her office had reported Carranza's illegal status to immigration officials after his two previous arrests.

Immigration and Customs Enforcement officials said they had scoured their records and found no such notification.

"My sense is now we were not contacted or made aware," said Scott Weber, Newark field office di rector for ICE's office of detention and removal.

Paul Loriquet, a spokesman for Dow's office, said its policy is to refer cases of illegal aliens to federal immigration authorities only after the defendant is convicted and sentenced. He said to do otherwise would risk having the defendant immediately deported before he could be punished for the crime.

Prosecutor is mum on notification of illegal status to feds...

I have personally noticed that the gun control advocates here in the Democratic People's Republic of NJ became suddenly silent when it was discovered that the suspect was an illegal alien.

I certainly hope the citizens - that’s Citizens - of New Jersey and the other 49 states take a good look at their officials and recall the few who shouldn’t be there because of some stupidity, then come election, replace a few more who won’t listen or, are acting unconstitutionally...it’s past time for the Americans to wake up and realize they must take an active role in our government at all levels in order to keep it honest. Went, IMHO, we show no interest in what the officials, both elected and appointed, are doing to us and the Constitution, we deserve what we get..not always what we really want.

I don’t call these “gaps”. I call them intentional actions by liberal activists to hurt US citizens.

More than “gaps in (the) legal system”, it was the failure of several Presidents and more Congressional legislators to uphold their oaths of office.

Yeah, Bergen County is definitely Bush’s fault.

Unless you want the Feds going around knocking on everybody’s door at night checking your birth certificate or immigration papers, you have to rely on local jurisdictions to do the first step: identifying and apprehending people who are violating immigration laws.

NJ doesn’t do this, Bergen County doesn’t do it, and neither do a lot of other states and cities. In fact, I believe Newark is a “sanctuary city.” Go find out what your local jurisdiction does - or does not do. I bet you’d be surprised.

But it’s so much easier to blame Bush.

This blood and the daily flow of American blood on American soil at the hands of illegals is clearly on the hands of this administration and every politician who wishes to provide the “sanctuary” of immigration “reform” and who also decries the ability to enforce the laws that make up our borders.

Bush is responsible just are all the other people representing us. But then so are we responsible because we continue to let these fools represent us. One person can’t fix it just as one person didn’t break it.

Since Bush Sr. was in office our govt has been going downhill.

An illegal latin alien murdered three blacks who headed for college execution style?

I'm speechless.

I'm going out on a limb here and guess that the little darling is a gang member.
I usually don't agree with cities or counties paying huge awards for incompetence and/or stupidity, but in this case I hope Essex County is warming up its checkbook.

I don't give a rat's elbow how "good" their intentions were.
