That wouldn't be too hard for a reasonably proficient examiner to prove. The detective in the teacher case was an incompetent idiot, and almost anyone in the business could tell that just from reading the news stories.
Yep, that's the most likely explanation. If I take over someone else's system, I not only format, I wipe the drive completely and reload from scratch.

After the Geek Squad kid copied them off for his own secret stash and messed up all the timestamps there ought to be enough reasonable doubt to drive a truck through. You don't get a good chain of custody at $8 an hour (or whatever they pay).
what about financial info and other info that is saved on my computer. I've got a file with passwords and account numbers on it. I've also got tax and income records on my laptop as well as my "regular computer".
How do I keep those out of the hands of repair guys that are helping me with my computer?

Encryption is the best solution. There are several good commercially available encryption programs (PGP, BestCrypt, TrueCypt, etc). Set up a container to hold your financial and other sensitive documents, and only encrypt that container. Just don't forget your password, and don't store the password on the computer anywhere!

I don't know what utility your systems use for "secure deletion", but as long as it overwrites the files with random data, as opposed to just marking the file deleted, you should be okay in most cases.
It depends. The Geek Squad kid viewing the files may have changed the last accessed date, but it will not change the date the file was saved to the hard drive. And unless the customer gave the Geek his username/password (never a good idea),it will not affect any information located in his profile.
