If he and/or the contractor are willing to fix things after a friendly phone call, you're set.
That's the plan for right now, he's got a guy coming out on Friday to look at it. I'm just wondering if that's a smart step or one step backward. I do like the guy.

Talk to your neighbor if your not enemies with him. Try to resolve without dragging outsiders into the mix. If you do this, be firm, but neighborly. Be truth with him and see how he responds. You might be surprised, something could be worked out.
If not, you can always go to an attorney.

Personally, if I felt that way, I’d get rid of the insurance. Unless you have to have it for a mortgage, its not doing you any good anyway.

OK, so you have an easement on his land. Have you talked to him?
You don’t want to have your insurance company pay for this. First, try and get him to fix it. Don’t contact his contractor. Let him contact the contractor. Don’t get in the middle.
Second, if he won’t fix it, have an attorney review your easement to make sure that he is responsible if he damages your pipes. If so, then have your attorney write a tough letter to him.
If it is not resolved, contact your insurance company and ask them.
If still not resolved, sue him if it is large enough to fool with.

The reason it was on my neighbors property is because I have a Salmon Spawning Creek in my backyard. I am the second owner of this house, alot of my neighbors have their drainfeilds on their neighbors property. These are large plots of land.

Call the tree trimmers insurance agent.Go through your neighbor. It's his responsibility. The tree guy was his agent, and they have no way of knowing. His deed must mention the easement. Or should.
He should be following up all this, not you.

Wouldn’t ya think if his drainfield was on someone ELSE’S property, he would have gotten the legal right to do it? Did not some bureaucratic inspector have to sign off on a septic system? Is a permit required to install a system in your jurisdiction? If all the answers were yes, than your beef is with your neighbor who allowed you to use his property and put in a drainfield. He had the obligation to prevent any damage to the land he effectively rents to you.
Just as a landlord has the obligation to protect the building as a whole.

i don't know since there is a known intentional cause and known perpetrator. but if they do, they prolly would want you to file some kind of police report or something too. just a wildassguess though
