SoCal investors sue Democratic fundraiser Norman Hsu
The Associated Press ^ | 09/22/2007

Posted on 09/22/2007 6:36:56 AM PDT by george76

A Laguna Beach investment firm filed a lawsuit against Democratic fundraiser Norman Hsu on Friday, claiming he defrauded investors out of at least $23 million and required them to donate to Democratic candidates.

According to the lawsuit filed by Briar Wood Investments, Hsu persuaded the company's operator to do business with him by taking him to star-studded Democratic Party events. There, the 56-year-old Hong Kong native was praised by New York Sen. Hillary Rodham Clinton, California Atty. Gen. Jerry Brown and others, the lawsuit said.

As a condition of doing business with the fundraiser, Hsu directed investors to make contributions to certain Democratic candidates, the lawsuit said. The investors turned over tens of thousands of dollars, including $30,000 worth of checks to Clinton's campaign on a single day.

The lawsuit is the latest in a series of legal troubles that continue to mount for Hsu.

Last week, New York investors filed a similar suit against Hsu. On Thursday, federal prosecutors unsealed a criminal complaint accusing Hsu of operating a national Ponzi scheme and reimbursing investors for donations made in their names. And on Friday, a San Mateo County judge ordered Hsu held without bail in a 1991 theft case.

According to the lawsuit, Waters invested with Hsu in part because "prominent persons, including Sen. Hillary Clinton, New Mexico Gov. Bill Richardson, California Atty. Gen. Jerry Brown, national Democratic political adviser James Carville, film director Steven Spielberg, actor (Tobey) Maguire, grocery store magnate/billionaire Ron Burkle and others introduced and/or endorsed Hsu as a friend, colleague and trusted associate."

If the hsu were on the other foot ---- if Hillary were being prosecuted for violations of campaign finance laws ---- you KNOW that Norman Hsu would also be charged as an accessory.

If he was using her, she was using him too, and it's arguable which one of them actually received and spent the larger amount of cash.

He was criminally raising money for her, and she was enabling his crimes. She was what made his dough-raking possible on the scale he had reached. Both should be charged, both received illegal monies and encouraged the activity.

That's not even counting what might turn up in deeper investigations.

Where's the headline?

So these investors believed Hillary & the other Dem’s when they praised Hsu as “trustworty”. Sounds like some quid pro quo going on here - however, any investor who is influenced by the endorsement of/association with Democrat politicians, deserves to lose every stinking cent they invest. Stupidity has consequences.

Good, another law suit.

This kind hearted liberal needs to sue everyone of these rotten rat sobs for fraud: According to the lawsuit, Waters invested with Hsu in part because "prominent persons, including Sen. Hillary Clinton, New Mexico Gov. Bill Richardson, California Atty. Gen. Jerry Brown, national Democratic political adviser James Carville, film director Steven Spielberg, actor (Tobey) Maguire, grocery store magnate/billionaire Ron Burkle and others introduced and/or endorsed Hsu as a friend, colleague and trusted associate."

Jerry Brown is our new attorney general, so Moonbeam was in bed with Hsu, the Clintoons, Burkle, Spielberg and Carville.

Maybe we should recall and bounce Brown out of office like we did Gray Davis. He has been trying to greenmale the gasoline refineries and auto makers since he took office.

LIFE AND TIMES OF NORMAN HSU

Early life

1951: Norman Hsu born in Hong Kong.

1973: Earns bachelor of arts in computer science from University of California-Berkeley.

1976-1984: Has a California real estate sales license.

1981: Earns a business degree from the University of Pennsylvania’s Wharton School.

Legal troubles

1982-1987: Hsu is a partner in apparel and real estate companies in Southern California and the Bay Area, several of which dissolve, leaving Hsu in debt for more than $750,000.

1987-1989: Moves to Foster City and recruits investors for new apparel and real estate businesses.

Feb. 13, 1990: A Southern California man files suit accusing Hsu of using a forged document to obtain an $85,000 loan secured by a San Carlos condominium.

Aug. 3, 1990: Hsu files for bankruptcy, owing creditors, including his father-in-law and ex-girlfriend, $1.6 million.

Aug. 28, 1990: Tells police he was kidnapped by captors connected to his creditors. Charges against them are later dropped.

Conviction and flight

1992: Pleads no contest to a grand theft charge, agreeing to serve up to three years in prison and pay $1 million in restitution.

1992: Fails to appear for sentencing; San Mateo County judge issues a bench warrant for Hsu’s arrest.

1992 to late 1990s: Authorities believe he is living in Asia.

Late 1990s to 2000: Returns to United States, spending time in New York and California.
2004-2007: Helps Bay Area Democrats raise money for Sen. Hillary Clinton, U.S. Rep. Mike Honda, D-Campbell, and others.

The past catches up

August 2007: News reports reveal Hsu is a fugitive from the 1992 conviction.

Aug. 31: Turns himself in to the San Mateo County Superior Court, posts $2 million bail.

Sept. 5: Fails to appear for sentencing; judge issues another warrant for his arrest. Hsu mails an apologetic letter to friends, who describe it as a possible suicide note.

Sept. 6: Surfaces in Colorado, where he is taken off an Amtrak train and hospitalized for undisclosed medical treatment.

Sept. 10: Clinton announces she will return $850,000 that Hsu ostensibly raised from 260 individual donors. Authorities are investigating Hsu business ventures in New York and Southern California.

Wednesday: Hsu appears in a Colorado courtroom and waives extradition.

Thursday: Hsu returns to San Mateo County.

Friday: Hsu appears in a San Mateo County courtroom, where his attorney called for dismissal of Hsu’s 1992 fraud conviction.

The prosecutor, Deputy Attorney General Smetana, was willing to let Hsu go if he would post $1 million bail and pay $1 million in restitution to his previous victims. It seems like the AG's office was not really interested in prosecuting Hsu or making serve his time, they were just going through the motions.

Jerry Brown is the AG and now this Waters guy is saying Jerry Brown vouched for this guy? The guy was a fugitive - was Brown AG then?

I wonder how many other state politicians could be dependent on Hsu? Always dripping in money, I bet he was a popular guy. We may have tons of recall material here, even if Smetana tries to let it slide again...

Excellent question. I don’t know when the felon and his character witnesses were together for their fraud.

A lot of us wondered where Moonbeam got all the money he got for his AG race.

There might be a significant basis for an investors’ suit against Clinton, et al, on the grounds that they negligently failed to check Hsu out adequately before they endorsed him, giving him the veneer of respectability that he then traded on and used to rope the investors into his various Ponzi schemes. Among other things, such a suit would force Clinton, et al, to reveal how much of a background check they actually made on him, from which could come a trove of other information. Right now one thing is absolutely sure: Clinton and the whole DemonRAt establishment bent over backwards to give Hsu as much fake respectability as possible, going even so far as to get him onto the board of the New School in New York.

Also noticed how Rabin depicted Her Thighness in a very unflattering way. :)

It's going to be hard for the "investors" to recover their money from Hsu himself, a bankrupt grifter, but the Witch and the DemonRat establishment that so benefited from Hsu's activities have more than enough to provide an adequate recovery. Hence, if the "investors" attorneys are really interested in recovering their clients' money, they'll need to go after the Witch and the DemonRat establishment, starting with a "negligent endorsement" cause of action.

I Agree! There is no way to believe that Hillary did not know about Hsu’s background and illegal activities. The Clintons have always investigated everyone – they have always amassed and maintained extensive files on everyone connected with them – and they have always used whatever method possible to get what they want. The Clintons have always behaved in accord with the adage “The end justifies the means.” This is just another example.

Or…think of this aspect that defines Hillary’s flawed abilities and turncoat personality: She is (stupidly) using as her defense that she “had no knowledge” of Hsu’s background - which, in such case, can only emphasize a very negative trait of hers, and not the mark of someone who should be trusted with leadership. If the Hill continues to proclaim she had no knowledge of anything Hsu had done/was doing that is/was questionable, and that she was totally in the dark about Hsu’s background then that excuse – only underlines her inability to be a good judge of character. It is amazing (rather, it is typical) how the Clintons have to constantly work to shed everything dark that they have done, or been connected with, or knew about once the cat gets out of the bag, by claiming they had no knowledge of any wrongdoings! What a wonderful trait – total unawareness - for someone who wants to sit in the White House and govern our country – NOT! If she admits to this ignorance of facts then she is stupidly admitting to her own lack of judgment.

If she can’t even discern who among her “cronies” is reputable, how can she be trusted for her insight dealing with national/international problems and personalities? Claiming she didn’t know in fact, exposes this as just another of her major leadership faults. She didn’t know? LOL. And now, she is attempting to excuse herself of any wrongdoing in order to distance herself from the crime. Give me a break. If she is afflicted with an inability to know what is going on and being done by people within her own circle (of trusted allies), how can she be trusted to judge anyone with any insight that she might have dealings with if (heaven forbid) she sits in White House?

Either way this is a Negative situation for Hillary – either: (1) She knew…and is guilty by association --- Or, (2) she did not know – and, then, how dumb can she be? Either way there is no tale she can tell, no way to wiggle out of this, no way to redeem herself, without exposing her serious judgment faults or total disregard for the laws and ethics. So now…which way will her PR people continue to spin this? This revelation about Hsu puts Hillary’s promoters between the proverbial “rock and hard place.” These are the only two Negative ways to look at and deal with this story, and in both cases it does not put Hillary in a good light. Either way, Hillary is exposed to be lacking in good leadership qualities.

However, I truly believe that she did know. And she just didn’t care, as long as the $$$ was coming in so she could achieve her goals. I am sure she felt the long arm of the Clinton cover-up team would keep this story hidden. And, if not…well, Hsu could always come to some unusual (timely) death, like so many in the Clinton’s past who had some knowledge of, or connection to Clinton secrets. Unfortunately, the “law” caught Hsu before the Clintons were finished with him, and his illegal antics and the Clinton awareness were unable to be proven after his death. Hsu will get jail time; but he should consider himself lucky – he is alive. Had more time passed – and his usefulness become unnecessary, I am sure his disappearance would have been made permanent by the Clinton “swat” team who have successfully eradicated others in the past.

I would like to know however: If someone can be suspected as an accessory to a crime if they even unknowingly drive a “get-away” car, or are guilty because they are in the presence of a group when a robbery with a gun is being committed, even if they did not hold the gun (ala OJ recently), or how a bartender can be charged with facilitating a motor vehicle accident by a drunk patron that he committed after leaving the bartender’s establishment -- or in any way how someone can be convicted if they have facilitated a crime -- then why isn’t Hillary under legal question for facilitating Hsu’s picking pockets for her benefit at some of her own fund raising festivities? Especially since the cost and sponsorship for such events was paid with money from Democratic fund-raising/Hillary’s coffers and Hsu was invited (and most likely approved by Hillary) specifically because of how he produced funds (illegal or not) and to be praised for doing exactly what he did best.
