At the very least, if I were this restaurant owner, I would ignore the letter from Clinton’s lawyers.
I would at least make them go through the expense of filing a formal complaint. I doubt it would come to that, since it is hard to see how Chelsea suffered any damages of any sort.
In any event, I doubt the law suit would survive a motion to dismiss anyway.
If it were me, I would fight it pro se just for the pure joy of unleashing against the Clintons my well practiced “pro se defendant from Hell” barrage of tactics proven to embarrass the other side and run up their expenses without incurring any of my own.
But since the restaurant owner probably doesn’t have the stomach for the fight, he should just decide to take it down when he’s ready and inform the judge — but only after he has caused the Clinton’s some legal expenses and bad PR.
If Chelsea was a minor when the photo was taken the Willy could probably make the request...if not, well Willy can shove it.
But she posed for the picture, so it was also consensual.
Additionally, the photo belongs to the restaurant owner.
Moreover, given the fact that restaurants have the right to display even indecent photographs, he has the right to display an innocuous one.
It can hardly be considered advertising since the viewers are already customers or prospective customers - they are inside the restaurant. It is not being used as an endorsement or a solicitation.
What this is is a man who has powerful friends and who wields enough influence to ruin this man's business threatening a man who has done nothing wrong.
Interesting letter. First of all, I don’t believe Bill Clinton has any option to demand changes regarding his adult daughter. Second, I note this Mr. Band claims in his close to be Counselor to President Clinton. Isn’t that Ex-President Clinton? Or is he thinking future? The letter is heavy-handed and ridiculous. It will bite the Clinton machine as an attempt to keep anyone from profiting from the name or face of a Clinton. After all, can’t let anyone make money off them!
If that picture is going to get him all upset, what would he do if she popped up on the internet vis-a-vis Paris Hilton?
The typical action the Clintons take when confronted with embarrassing pictures or documents is to send in the goons to steal them. I’m surprised Bill didn’t do it in this case. He must be preparing for the role of dignified, First Lady. Next thing you know, he’ll be baking cookies and working with a needy girl’s club.
The guy owns the restaraunt,the wall the picture hangs on and the picture. Tell Klintoon to “sue me!”
