Murtha Must Testify in Defamation Case
The New York Times ^ | September 29, 2007 | Staff

WASHINGTON (AP) -- A federal judge refused Friday to dismiss a defamation case against Rep. John P. Murtha and ordered the Pennsylvania Democrat to give a sworn deposition in the case.

A Marine Corps sergeant is suing the 18-term congressman for alleging ''cold-blooded murder and war crimes'' by unnamed soldiers in connection with the deaths of Iraqi civilians in the town of Haditha. The deaths became prominent in May 2006 when Murtha, who opposes the Iraq war, said at a Capitol Hill news conference that a Pentagon war crimes investigation will show Marines killed dozens of innocent Iraqi civilians in the town in 2005.

U.S. District Judge Rosemary M. Collyer .... said she was troubled by the idea the lawmakers are immune from lawsuits regardless of what they say to advance their political careers.

A truly refreshing decision out of a Federal Court. I think I could fall in love with this judge.

Flies in the face of the 14th Amendment. Either we are equal under the law or we are not.

If anyone from Murthas district had any “gravitas”, they would go after him with “extreme prejudice”.

Is not Murtha a WWII vet? If so, wouldn’t he be liable for the deaths of over 200,000 civilians when we fire bombed Japan and Germany? I’m not saying that what we did as a nation was wrong....it ended WWII and saved over 500,000 of our troops. War is war and crap happens during war. This guy is an insult to the American people and should not be allowed in Congress.

Semper fooey, Murtha.

Related thread. Most of Murtha's statements on this subject were made from his office in PA.

Whatever gave you the idea that was are equal under the law. Jack Murtha is laughing his fat ass off as the House Counsel dusts off the Speech and Debate Clause which protects our elected lords and masters from any accountability for any statements made in their official capacity. Murtha will never see the inside of a court over this. (:^| )

Excellent news.

“U.S. District Judge Rosemary M. Collyer .... said she was troubled by the idea the lawmakers are immune from lawsuits regardless of what they say to advance their political careers.”

Maybe some of our Nam Vets, who suffered from Kerry’s, Kennedy’s and Fonda’s lies can sue these liberal bastards for defamation.

The public airing of the dispute can only help galvanize our side.

True, it cannot hurt him amongst the dems, but that would be an impossible task. - holding their leaders to an ethical standard, that is.
