SAN DIEGO - An investigating officer has recommended that a Marine who led his squad in an assault that killed 24 Iraqi men, women and children should not be tried for murder, a defense attorney said.
If the general overseeing the case accepts the recommendation, as is likely, no one will face murder charges in the biggest case involving civilian deaths in Iraq.
Lt. Col. Paul Ware on Thursday recommended that Staff Sgt. Frank Wuterich, charged with the unpremeditated murder of 17 Iraqis, should be tried instead for negligent homicide in the deaths of five children and two women in the Iraqi town of Haditha, Wuterich's attorney Neal Puckett said.
Wuterich, 27, has said he regrets the deaths but had operated within combat rules and "made the best decisions I could have at the time."

All charges should be dropped, there should be no discussion of negligent homicide, I hope that General Mattis (or whomever will make the final decision) drops ALL charges and then reprimands NCIS or whomever brought the charges in the first place.
I want all these marines to sue Time for the false story, Murtha for slander, and walk away with millions of dollars for the pain and anguish they have experienced by these outrageous charges.
Will Murtha apologize for slandering brave Marines who fought our enemy on foreign soil, then had to face outrageous charges from elected representatives of their own government??!!
(It’s a rhetorical question - I won’t hold my breath waiting for a traitorous liar like Murtha to apologize!)
This way, Murtha would not be able to slither out of his blanket charges against these men. He would have absolutely no hook on which to hang the vile slanders he made at the onset.
Please, God, let the right decision be made in this case pending before the military tribunal.
