BOSTON, (AP) -- An appeals court cleared the way Friday for a Harvard student to receive extra break time during a lengthy medical licensing exam so she can pump breast milk for her infant daughter.
The state Appeals Court refused to overturn a decision issued by a single justice of the court last week allowing Sophie Currier, 33, the extra time. The decision clears the way for the woman to take the exam next week.
The state Supreme Judicial Court already has declined to hear the case.
Currier sued after the National Board of Medical Examiners said she could have only the standard 45 minutes of break time during the nine-hour exam.
Last week, Judge Gary Katzmann of the Appeals Court ruled in favor of Currier, saying she needs the extra break time to pump breast milk to feed her 5-month-old baby. Katzmann said if she didn't get the extra time, she would not be on "equal footing" with men and non-lactating women who take the test.
Ignoring the need to pump could cause her significant pain, Katzmann said.
The licensing board appealed Katzmann's ruling to the full, three-judge panel of the appeals court. On Friday, the full court refused to overturn Katzmann's decision.
The court said it based its decision on whether Katzmann abused his discretion or made a clear error of law. The court said it found neither. It did not rule on the merits of the case.

Okay guys, get all indignant. My wife breastfed all three of our wonderful children, and not being able to feed the baby on time, or express milk, was very painful.
A brief break for her to pump milk is on par with letting a student with impaired vision have a lighted magnifying glass, or providing some way for a student whose dominant hand is in a cast sit for the exam without having to write the answers, and far less disruptive of the examination process than either. Harvard Med was just doing what med schools everywhere do, trying to constrict artificially the supply of physicians to keep physician fees (and medical costs) up.

Why is this now the school’s problem? What a selfish idiot.
1)While her peers take the 9+ hour test in one day, this whiner takes it in two (ADHD/dyslexia)
2)The Board offered her a private room where she could pump while taking the 4 1/2 test (Over two days mind you)
3)The whiner already has failed this test with the two day advantage
4)The whiner cannot go 1 hour past her “scheduled” feeding (The whiner says she needs to pump every 3 1/2 hrs and takes 1 hour to do it)?
5)Women who have breastfed and taken this test (In one day mind you) have testified that the Board gave them plenty of time to pump while on normal break
I can go on but if you still think this whiner is not trying to game the system then all hope is lost on you.
Te board was more than accommodating with the options she was offered.
when will those who scream anti-woman, anti-breastfeeding, anti-family, to those who oppose this scam, appear?
