Worker guilty of sex assault on girl, 6

A former worker at the Metropolitan Plant Exchange in Paramus was convicted Friday of sexually assaulting a 6-year-old girl who briefly wandered away from her mother.

The verdict, which came after three hours of deliberation, will put 25-year-old Silas Quixal in prison for at least 20 years and clears the way for a civil case to proceed against the Route 17 store.

The girl's parents allege in a lawsuit that the store put shoppers in danger by hiring Quixal, who is an undocumented immigrant.

Assistant Bergen County Prosecutor Liliana Silebi told jurors during the trial in Superior Court in Hackensack that Quixal lured the girl into a rear storage room while her mother was looking around in the store, holding her other daughter.

"This was a very brazen attempt to sexually assault a little girl in the middle of the day, in a business establishment," Silebi said.

Quixal later confessed to police, and investigators retrieved DNA evidence from the girl's clothing that matched samples taken from Quixal, Silebi said.

Quixal's lawyer, Michael Orozco, argued that Quixal had trouble understanding English and did not know what was going on when he confessed to police. Quixal also testified during the trial that he was roughed up by police before he confessed.

"My client has obviously expressed disappointment with the verdict," Orozco said later. "Whether he will consider an appeal is something I will have to discuss with him."

Superior Court Judge Eugene H. Austin revoked Quixal's bail after the verdict and ordered him held at the Bergen County Jail pending his Dec. 14 sentencing.

Among those who attended the trial regularly were attorneys for the girl's family and for Metropolitan Plant Exchange, who are gearing up for a battle in civil court.

"Metropolitan Plant Exchange is equally responsible," said Todd Siegel, the family's attorney in the civil case. "They chose to hire an illegal alien with no background and put a little girl in danger."

Paul Faugno, a lawyer for Metropolitan Plant Exchange, said Quixal worked at the store for six years without a problem. The store can be held liable only if it knew Quixal was likely to commit a crime, Faugno said.

"The fact that he is an alien is a red herring that has nothing to do with the case," Faugno said.

If I was on the jury the mother would own the store when the case was over.

......SO..... The fact that, when they hired him he didn’t have a DL or an SSC....Ya’know things like I MUST HAVE to get a job is irrelevent? Which means that they hired him just ‘cause? I have a number of choice words for what I think, none of which would be proper here. My prayers and thoughts will be for the little girl and her family.
