The decision runs counter to Mr. Spitzer's order, in which illegal aliens with valid foreign passports would be eligible to obtain a state driver's license.

A New York driver's license which could then be readily exchanged for a driver's license in any of the other 49 states.

The issue heated up late last week, when the Monroe County legislature defied the governor and ordered its county clerk to require anyone seeking a driver's license to provide a valid Social Security number.

That's like asking someone to prove their Catholic by naming A pope. Illegals already have stolen SSNs.

Per the Real I.D. Act of 2005 ...

Immigration Requirements Verification of U.S. Citizenship and Lawful Status §202(c)(2)(A), (B)

Before issuing a DL/ID, a state shall require and verify valid documentary evidence that the person: (i) is a U.S. citizen, (ii) is an alien lawfully admitted for permanent or temporary residence, (iii) has a conditional permanent resident status, (iv) ) is a refugee or has been granted asylum, (v) has a valid, unexpired nonimmigrant visa or nonimmigrant visa status, (vi) has a pending application for asylum, (vii) has a pending or approved application for temporary protected status, (viii) has approved deferred status, or (ix) has a pending application for adjustment of status to that of an alien lawfully admitted for permanent residence or conditional permanent resident status.

Is Spitzer planning on complying with the lawful requirements in making the non-conforming ID's a different color or in other ways, different?

In any case in which a state issues a DL/ID that does not satisfy the federal requirements, a state shall ensure that that the DL/ID: (A) clearly states on its face that it may not be accepted for federal identification or any other official purpose, and (B) uses a unique design or color indicator to alert federal agencies or other law enforcement personnel that it may not be accepted for any such purpose.

Maybe it's just another law Spitz can ignore. Good thing he's the guv.

Well, as long as they leave California and go to the East Coast, I’d be Ok with it, but they won’t in the kind of numbers required to pull the collective head out of the east coast’s @ss.

By the time they get a dose of -actual- multiculturalism in action, it will be too late.

Our illustrious senator Charles Schumer was asked about Spitzer’s illegal alien driver’s license scheme. He said that he didn’t want to get involved in what he viewed as a state matter. He did, of course, have time to get involved with signing the Rush Limbaugh smear letter.

Since a driver's license is used for driving, boarding planes, renting cars, getting hotel rooms,... one way to stop this would be for the other states to refuse to recognize any New York driver's license.

After all, if a state cannot tell the difference between people here legally or not by this license, how else can it protect itself but by assuming that they are all fake. Essentially, New Yorkers would then be unable legally to travel anywhere outside of the state.

That would create such a stink, that the governor would have to rescind his order.

A Zogby survey of 718 likely voters in New York found that 65 percent of the state's voters are against the proposal.

Snort. It's a lot higher than that.

And any local elected official who doesn't do his/her darndedst to stop Spitzer from going ahead with this is going to lose his/her job.
