That’s not exactly true. There was testimony that special operations uses it. I’m not sure if I read it in the media or in a write-up of the trial, but I know it somehow or other.
Besides, it makes sense.

This is still amazing, to me, that the US gov’t is forcing a “murder” hearing in Iraq. This is so wrong to force family to go through this much effort and then pay for the additional cost just to try to support their loved one.

But now many in the military establishment want to further their careers and prove their own moral superiority.

I’m not sure, but I find it strange that a General Court is being held overseas. In the Navy, GCMs were sent Stateside, only Summary and Special were held within the Command. That’s from back in the 60’s, so they may have changed their procedures. Does a “Change of Venue” appear possible?
Sounds crazy to me. It forces the lawyers and their aides along with family members to travel overseas with all the additional costs associated. I don’t think it’s a cheap trip. Additionally, I imagine it limits accessability between the client, civilian lawyers, and JAG lawyers as they work on a defense. I have no idea why the venue is not stateside. One logical conclusion might be that it is a coercive tactic. This is a murder trial for goodness sake.
Of the three snipers involved in these incidents, Sandoval’s trial was completed in Baghdad, Hensley’s trial is currently underway, and Vela’s hearing is scheduled to start this weekend in Baghdad. BHfred would know more.
