PAPILLION, Neb. - Shirley Phelps-Roper and her attorney want to know exactly why she has been criminally charged for protesting at a Bellevue soldier's funeral in June, so they can challenge the charges.
Phelps-Roper and her attorney, Bassel El-Kasaby, asked a Sarpy County judge Monday to order prosecutors to spell out in writing why she is charged with flag mutilation, negligent child abuse, contributing to the delinquency of a minor and disturbing the peace. They say the details of those charges will be important to Phelps-Roper's defense.
"This case clearly raises some substantial constitutional issues," El-Kasaby said.
Phelps-Roper is a member of the Topeka, Kan., based Westboro Baptist Church, whose members believe that U.S. troop deaths in Iraq are punishment for the nation's tolerance of homosexuality.
The protesters carry signs bearing such slogans as "Thank God for dead soldiers" and "God hates fags." Followers say they are entitled to protest at soldiers' funerals under the First Amendment, which guarantees freedom of speech and religion.
Monday's hearing did not attract protesters. Instead Phelps-Roper brought only a few family members for support. Phelps-Roper said she believes Sarpy County prosecutors are persecuting the Westboro church.
"This nation _ and in particular this city and this county and this state _ is experimenting with our liberties because you don't like our message," Phelps-Roper said.
But Sarpy County Attorney Lee Polikov said Phelps-Roper's decision to allow her 10-year-old son to stand on an American flag during the protest justified the prosecution because violence could have ensued.

Her attorney appears to be Arab. I wonder how many Arabs there in all of Kansas. Well well well.

Article III, Section 3, Paragraph 1, of the Constitution of the United States:
"Treason against the United States, shall consist only in levying War against them,
or, in adhering to their Enemies, giving them aid and comfort."
The "aid and comfort" prong of treason has been interpreted
by SCOTUS as requiring proof of four elements:
1. an intent to betray the United States (which can be inferred from);
2. an overt act;
3. witnessed by two people; and
4. that provides aid and comfort to an enemy of the United States.
A prime example of how hate affects ones appearance. ick.

I don’t often advocate violence as a solution to a problem, but in the case of the Phelps family, I’d make an exception...
Oddly enough...
Their day of chastisement and reckoning has come.
I just didn’t expect her to look so crazy.
I used to ride a city bus when I was in High School, and often we would have this lady who would hold signs outside the local court house. Crazy signs like “FBI is Jewish Nazis” and “Red Square, Everett”. She looked somewhat normal for how crazy she was.
