DOJ will not investigate Nifong

RALEIGH (AP) — The U.S. Department of Justice will not investigate former Duke lacrosse prosecutor Mike Nifong for his handling of the case, a spokesman for the agency said Wednesday.

That decision also jeopardizes a possible investigation at the state level, according to a spokeswoman for Attorney General Roy Cooper, who said prosecutors in North Carolina can't indict someone on charges of lying to investigators.

The DOJ carefully considered the case but decided that it was an issue better resolved inside the state, said spokesman Peter Carr in a statement.

"We believe the State of North Carolina has the primary interests in this matter: protecting the integrity of its judicial proceedings, holding Mr. Nifong accountable for his actions as an officer of its courts, and vindicating the principles of justice under state law," Carr said.

Jim Hardin, who stepped in as an interim Durham district attorney after Nifong resigned from the office, requested that the State Bureau of Investigation determine whether any person involved in the case should be prosecuted.

SBI spokeswoman Noelle Talley said "it would be difficult to conduct additional investigation into this matter without federal participation."

"Our attorneys and the SBI will discuss the impact of this refusal," Talley said.

Nifong pursued charges in the spring of 2006 against three Duke lacrosse players falsely accused of raping an exotic dancer during an off-campus party. He resigned from his seat after state prosecutors dropped the charges against the players. He has since been disbarred.

Nifong also spent a night in jail after a judge held him criminal contempt of court for his conduct during the case.

On the one hand, I do think it’s properly the state’s job to handle this kind of thing.

On the other hand it’s certainly true that if the victims had been black, the feds certainly would have intervened.

The proper solution to that would be to end all federal interventions in crimes that the states should handle.

Finally, there’s something wrong with the laws in North Carolina if they can’t indict without federal support. That just doesn’t compute.

If this had been a white prosecutor who had done this to three black men on the word of a white woman, they'd have broken the land speed record to get down to cases. They've done it in the past.

Roy Cooper is the same two-bit fraud who crawled out of his spider hole to adjudicate the Duke Lacrosse fiasco only when it became apparent that his political future and career was in jeopardy if he didn’t, and of course only after the corrupt District Attorney Mike Nifong’s phony case lay in ruins. Then and only then did this rat crawl out and take credit for what independent efforts on the behalf of talk radio and conservative internet bloggers had already accomplished.

Roy Pooper Scooper is likewise doing absolutely nothing to address the debacle of illegal aliens being admitted to NC taxpayer supported community colleges that his boss, another sawed off, rotten little Demo-rat coward endorsed before he hid under his desk until his term was up. The last thing North Carolinians need is another gutless, corrupt, and vile Dumbocrap administration whether it is led by Pooper Scooper or some other liberal Democrat idiot.

I didn't. I think there must be some middleground between pursuing and punishing only your political enemies with a vengeance like the Clintons' did, and refusing to investigate anything except the transgressions of those who have supported you while giving a pass to those who wish to do you in.

I have serious doubts that the Clintons would have done anything but ignore Nifong since he is one of their own.
