Commission says Virginia can’t deny all illegals bail

The Virginia State Crime Commission Thursday rejected a plan to deny bail to all illegal immigrants arrested for minor crimes, saying the proposal would be impractical.

Jail overcrowding problems and financial limitations forced the commission to scuttle the idea, which is likely to come before the General Assembly in January.

“If we denied bail to every illegal immigrant, pretty soon, Fairfax County would be broke,” said Del. David Albo, R-Fairfax County.

Instead, the commission endorsed an alternative that would deny bail to any illegal immigrants the federal government would pay to hold as they awaited trial. It’s not clear how many of the thousands of illegal immigrants who are processed at local jails would face no-bail restrictions, or how much that would cost.

While the most dangerous suspects are already held without bail, lawmakers have been trying to reject bail for more illegal immigrants.

The commission’s plan would direct the state to work with federal Immigration and Customs Enforcement officials to determine which crimes would meet guidelines to merit deportation proceedings. “What we decided to do would be to deny bail to all illegal immigrants ICE would pay for,” he said, noting it is not clear which crimes would make the cut.

The decision was hailed as common sense by immigrant advocates and harshly opposed by others who had hoped to keep them behind bars.

“I don’t understand why they think an illegal immigrant who has committed a crime against a Virginia resident should be released on bond when there is a very good chance they will not return for trial,” Prince William County Chairman Corey Stewart said.

Gov. Tim Kaine had expressed support for such a plan in the fall but had warned that it would carry a huge price tag. Mexicans Without Borders coordinator John Steinbach said the commission finally grasped the notion that the vast majority of illegal immigrants are not threats to the community and that holding them all would be impossible.

Gov. Tim Kaine had expressed support for such a plan in the fall but had warned that it would carry a huge price tag.

If it would carry a huge price tag, that has to mean that illegals commit a huge number of crimes in the state. Otherwise, the cost of holding them should be something that a state as prosperous as Virginia could handle.

This comment is even more telling. Fairfax County supposedly has the highest per capita income in the country. If it can't afford to hold illegals who commit crimes, they must be committing quite a lot of it.

The question is why do we need state elected officials if the state is going to be run by an unelected crime commission?

What we need is a Federal law which states that when the INS gets a call from any state,country or local police department or sheriff's office or any other law enforcement agency that it has in custody a person who is known to be,or suspected to be,in this country illegally the INS must come and take this individual into custody within 12 hours of having received the call.

No exceptions.

This is the same Dave Albo who came up with the new “traffic violation fines,” which are MASSIVE annuals fees taken from Virginians for thinks like speeding. And it only applies to Virginians. The thousands of commuters from D.C., Maryland, North Carolina, Tennessse and other states are covered, so there goes the “safety” argument.

The bill forces more Virginians to hire lawyers to fight tickets in court. And Dave Albo just happens to be a lawyer specializing in traffic cases. Ka-ching!

The county doesn't have the authority to deport them.

They are saying that they will hold all illegals that ICE will deport since ICE will pay for the costs of holding them.

The real problem is with the federal government not doing their job, which puts state and local governments in a horrible situation.

What the state and local governments can do it make it harder for illegal immigrants to find housing and jobs.

That will make many self deport, and also make many not fight their deportation, which means the courts can process more deportations more quickly.

The state and local governments need to stop providing havens for illegal immigrants, and to make life more difficult for them. However, deporting them is still the role of the federal government.

However, if you let them go, Fairfax County will be broken. What happened to ICE picking them up and deporting them? Is it not in the law of the land?

Charge the “magnets” for attracting these illegals into the country....
Remove the “cheap labor” that has become so expensive and destructive to our society and culture.
The “giveaways” offered to illegals INCLUDE those given by City, State and Federal agencies -— they too should be SHUT OFF.

Then — everyone could learn from the successes of LOW COST incarceration of criminals from Sheriff Joe Arpaio in Arizona....

Criminals are NOT entitled to a “rose garden” encarceration....prior to being deported back to their Turd World home they honor more than the country they’ve escaped to....

They should NOT be any more comfortable than our warriors in harm’s way.....

They should be sent back to wherever they came from, and the nation of their origin billed for the cost of apprending and trying them. If said naiton will not pay what they are assessed, their assets in America should be seized to pay said assessments.
