Duke Lacrosse Witness Nominated as 'Everyday Hero'

Durham — Reader's Digest has nominated a cabdriver whose testimony helped clear a Duke lacrosse player for its 2008 Hero of the Year Award.

Moezeldin Elmostafa, 38, of Durham, told investigators that Reade Seligmann was in his taxi during the time that Crystal Magnum, an exotic dancer, claimed she was raped by Seligmann and two of his teammates on March 14, 2006.

Elmostafa maintained his innocence and was acquitted at a trial in August 2006

Yep, and despite the eye witness, irrefutable phone records, DNA evidence that did not match, and an ever changing story by the 'victim', they still prosecuted him.

The magazine says it picked these people, because they "risk their own lives to help people in trouble ... without expectation of accolades or even a thank-you."

Nifong should be prosecuted and sent to the gallows. This kind of prosecutorial misconduct should be a capital offense.

“Should” is not what will happen. There are already attempts by the hardcore left (who still do not believe the Duke boys are innocent) to rehibilitate Nifong and push him for higher office (such as Congresscritter). I can only hope they will fail. However, I am afraid that they might succeed. Others in the Demoncratic party that have done just as bad have succeeded.

The system has more or less taken care of Fong, but the system itself needs changing. The job of DA itself involves gigantic power and vanishingly close to nothing resembling accountability and, as such, it is a natural magnet to psychopaths like Fong. The job needs to be abolished and we need to get rid of the entire “adversarial” system of justice and adopt something like you see in France which they term an “inquisitorial” system in which the common incentive of all parties is to figure out what the **** happened and who if anybody needs to go to jail over it. NOBODY should ever have any sort of a career or money incentive to simply put people in prison.

Elmostafa deserves this award. He is a great man. He came forward and told the truth because it was the right thing to do. And when Nifong & Company tried to make him change his story he never would budge.

The same thing goes for Gottlieb, Himan and a few other Durham police officers. Also some judges that handled this case and others cases indirectly related to this case need to be removed from the bench.
