If you click on the link, check out the new smoking ordinance in Fort Worth. Humorous that they have it on the front page as if there is an amber alert or a manhunt.

Not entirely unfair. No smoking in restaurants with chilluns. You can still smoke with fat drunken adult slobs in bars.

Once again, if judges wouldn’t let DUI’s off with a stern look, we wouldn’t be force to be poked with a needle for no reason than the cop had nothing better to do that day.

While I’m totally against driving while intoxicated I seem to remember reading something in an old dusty document once about the right to refuse to give evidence against yourself in a criminal proceeding.

Don’t this seem odd, you have the right to remain silent but we are going to get your breath, blood etc... even if we have to hold you down and take it from you by force.

Aside from possibly being unconstitutional, aren't there any laws in TX requiring that someone who draws blood must be a trained medical professional?

I seem to have read that alcohol is leached from your blood in a relatively short time. Are they going to keep magistrates up night and day? After the warrant is issued, and you make yourself scarce for an appropriate time, where will be the evidence?

I believe that in the state of Missouri, you do have the right to refuse a BAC breath test when pulled over, however it will mean an automatic 1 year drivers license suspension. Even if you haven’t been drinking. It’s a case of presumed guilty until proven innocent.

I would think that a trained medical professional ought to be doing this procedure.

Imagine the following case. A hemophiliac that has not been drinking is stopped at a checkpoint and told to take a breathalyzer test. After refusal, the officer arrests the driver and takes him to the center for processing. During the process, the driver is cut or starts bleeding from the punctured blood vessel. The driver loses a lot of blood and possibly his life as no police personnel have any idea why he is bleeding so much. Liability, anyone? Lots of liability?
