Huckabee on Altering Constitution for Religion

At approximately 4 minutes into this interview, Governor Mike Huckabee states the Constitution is a "...living, breathing document..."

This is a decidedly liberal view of the constitution.

As Huckabee points out in the interview, the amendments to the constitution give us the right to free speech, the right to freedom of worship, the right to bear arms.

I haven't listened to the interview but, if that's what he said, he has no clue what the Constitution is about. The Bill of Rights guarantees pre-existing rights. It doesn't grant them.

Nope, Schmuckabee is wrong.

God gave me those rights. The amendments in the Constitution prohibit the government from passing laws to curtail them.

If people think George Bush puts his foot in his mouth- Huckabee also said (in this interview) amending the constitution is “why African-Americans are considered people..”

It’s hard to know if he says what he really thinks- or if if simply doesn’t think..

If you are going to be an originalist or strict constructionist you need to look at the Constitution itself to see what the founding fathers envisioned for its amendment.

The constitution does not say “amend me rarely”, nor does it place any restrictions on the subject matter of its amendments. What the founding fathers did was establish an amendment system which requires a broad consensus (2/3 of house, 2/3 of senate, 3/4 of the state legislature, president has no say, thereby insuring that it will be amended infrequently.

History shows mixed results with some amendments good (abolition of slavery, voting rights)some not so good (income tax,direct election of senators). I’m referring only to post-Bill of Rights amendments.

In my view no one should be vilified for supporting an amendment using the Constitutional amendment process. However, the phrase “living, breathing document” refers to changing the clear meaning and intent of the Constitution by judicial activism (such as Roe v Wade)

I don’t have audio so I don’t know what Huckabee said or its context, but using that term shows naivete at the least.
There are sufficient reasons otherwise for conservatives to oppose Huckabee (I am an evangelical Christian who does not support him). There is no need to try to paint him as some wild eyed Theocrat

Eventually, CNN will likely have the text of the interview available...

Huckabee strongly believes in amending the consitution to reflect the right to life and man/woman marriage. That’s fine- it’s a view shared by thousands, maybe millions of Americans.

For me- and many other I think- when we hear “living, breathing constitution”..it’s a RED FLAG.

At the very least.

He tried to support the HLA by referring to the Preamble, which is OK, I guess. Strategically, I do not see that amendment even getting to the states.

His characterization of the "granting" of rights by constitutional amendment is indicative of a huge gap in his understanding.
