AN ACT TO PROHIBIT CERTAIN FOOD ESTABLISHMENTS FROM SERVING 1 FOOD TO ANY PERSON WHO IS OBESE, BASED ON CRITERIA PRESCRIBED BY 2 THE STATE DEPARTMENT OF HEALTH; TO DIRECT THE DEPARTMENT TO 3 PREPARE WRITTEN MATERIALS THAT DESCRIBE AND EXPLAIN THE CRITERIA 4 FOR DETERMINING WHETHER A PERSON IS OBESE AND TO PROVIDE THOSE 5 MATERIALS TO THE FOOD ESTABLISHMENTS; TO DIRECT THE DEPARTMENT TO 6 MONITOR THE FOOD ESTABLISHMENTS FOR COMPLIANCE WITH THE PROVISIONS 7 OF THIS ACT; AND FOR RELATED PURPOSES. 8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 9 SECTION 1. (1) The provisions of this section shall apply 10 to any food establishment that is required to obtain a permit from 11 the State Department of Health under Section 41-3-15(4)(f), that 12 operates primarily in an enclosed facility and that has five (5) 13 or more seats for customers. 14 (2) Any food establishment to which this section applies 15 shall not be allowed to serve food to any person who is obese, 16 based on criteria prescribed by the State Department of Health 17 after consultation with the Mississippi Council on Obesity 18 Prevention and Management established under Section 41-101-1 or 19 its successor. The State Department of Health shall prepare 20 written materials that describe and explain the criteria for 21 determining whether a person is obese, and shall provide those 22 materials to all food establishments to which this section 23 applies. A food establishment shall be entitled to rely on the 24 criteria for obesity in those written materials when determining 25 whether or not it is allowed to serve food to any person. 26 (3) The State Department of Health shall monitor the food

I agree. Morbid obesity results from food addiction. It should be treated as an addiction just like alcoholism or drug dependency. This proposed law equates to a kind of prohibition which doesn’t work. Besides that, it is unconsitutional.

You would expect this in New York or California...NOT Mississippi. Some research into who introduced the bill ought to be done. I’m going to guess that this is not a native Mississippi individual...and they don’t travel in their state much.

As soon as some enterprising lawyer were to figure out that more women were affected than men, the discrimination lawsuits would start to fly and the legislature would have to repeal this thing. Assuming it became law, which it wont.

Well, since the main obesity problem in Mississippi (and most everywhere else) is concentrated among Blacks, especially poor Black women (Hispanics are hard hit also), thats exactly what would happen.
Miss. was once a Conservative stronghold. The Republican Party in the South was once strongly Conservative. A lot of that is History now. Even in Texas a large number, but not all, of statewide officials (Who are all Republican for now) are Moderate to Liberal as evidenced by our own Guv Rick “Goodhair” Perry who was re-elected by a whopping 39% of the vote in a 4 way race.

I think I read somewhere there was a percentage point of interest in the obesity factor of those that live on the internet and that often frequent forums.
Is it a defensive gesture?

These are the types of issues the ACLU should be looking at; preventing obese people from being served food.

Will the restaurants be required to have scales and charts at the front door ?
