New York Democrat: Just Say "No" to Taxing Drug Dealers

ALBANY, NY--Stop the presses! A “prominent” New York State Democrat has complained that a tax might hurt small business people.

Of course, in this case, the small business people are crack dealers.

The New York Post reports that:

Assemblyman Jeffrion Aubry told Spitzer Tax Commissioner Robert Megna during a legislative budget hearing that requiring drug users and dealers to pay state sales tax on their illegal stash is an undue burden since they already face fines and possible forfeiture of property and money.

"This component adds another financial hardship on people who don't have a lot of money," Aubry said.

Currently, New York State has the highest taxes in the nation.

It is unknown whether Aubry’s concern for potential felons will be extended to other business people in the state. However, according to the Business Council of New York State, the Queens Democrat has a grade of “D” in the area of job creation and other economic issues.

LOL, the Democrat is an idiot for the reason he gave, but really, what drug dealer is going to submit sales tax on drug sales?

If you own a drugstore and sell magazines and candy...you get taxed.

If you sell illegal drugs on a corner, Democrats don’t want to burden you.

They've tried this with marijuana tax stamps, and the main concern was that purchase of the stamps might make it impossible to prosecute drug dealers:

Since I wrote the above, something interesting has happened. The authorities in Arizona arrested a fellow who was selling marijuana, and he had a license and had put the tax stamps on his "product". A judge decided that if the state sold him a license, they shouldn't arrest him for selling the product so licensed. So he dismissed the charges against the fellow.

What if we just tax crack at the same rate as powder cocaine? We'll just have the CIA and GOP file a report on how much their convoys deliver to the minotiry communities and assess it based on those numbers.

Texas implemented this back in the late 80’s and the purpose was to give them more latitude over prosecuting misdemeanor dealers/possessors with an Al Capone type offense and more strength in deterrent if it could be used to seize property. They set arbitrary taxes on drug amounts by weight.

He’s right for the wrong reasons.
If the state taxes harmful activities they tacitly endorse them. I disagree with my elected gov. Raising revenues off illegal monies. Seize the money,sure but do not tax it.

No taxes should be levied on illegal activities. That makes government complicit in the acts and in some cases tempted to look the other way.

They already have seizure laws on the books anyway.

Actually, the way these taxes work in practice is that thay you need to catch they guy with the untaxed drugs first (almost no one buys the stamps up front.

Good point! I remember back in the middle 80's when I lived in Oklahoma my uncle owned/ran a construction company. His office assistant bilked him out of $10,000 over a period of time.

To make a long story short what they nailed her on was not stealing the money but rather on the fact that she took the money out as pay on non-existant employees and she didn't take out employment taxes or something similar. It was an IRS/tax issue not a theft issue.

My uncle didn't care as long as they got her. He never saw the 10G's again though.
