Kennedy’s remarks might be a good thing, and might be a bad thing.
From reading the transcripts, I definitely got the impression that Kennedy realizes he has to deal with the case from an intellectually honest and historically accurate perspective.
Ms. Ginsburg, OTOH, I got the feeling that her questions were designed as a sort of fishing expedition trying to elicit responses that could be used to support the collective right interpretation.
It was pretty poorly argued from the DC side. Gura could have been a bit more unyielding, but I got the feeling that he thinks the outcome might have been jeopardized if he was more aggressive.
Just wondering - if they rule it a collective right, will Souter come to my door and ask me to give him my guns?
