STATE OF OKLAHOMA 2nd Session of the 51st Legislature (2008) HOUSE JOINT RESOLUTION 1089 By: Key AS INTRODUCED A Joint Resolution claiming sovereignty under the Tenth Amendment to the Constitution of the United States over certain powers; serving notice to the federal government to cease and desist certain mandates; and directing distribution. WHEREAS, the Tenth Amendment to the Constitution of the United States reads as follows: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."; and WHEREAS, the Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and WHEREAS, the scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and

WHEREAS, today, in 2008, the states are demonstrably treated as agents of the federal government; and WHEREAS, many federal mandates are directly in violation of the Tenth Amendment to the Constitution of the United States; and WHEREAS, the United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and WHEREAS, a number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States. NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE 2ND SESSION OF THE 51ST OKLAHOMA LEGISLATURE: THAT the State of Oklahoma hereby claims sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States. THAT this serve as Notice and Demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers. THAT a copy of this resolution be distributed to the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, the Speaker

of the House and the President of the Senate of each state's legislature of the United States of America, and each member of the Oklahoma Congressional Delegation.

What I still don't get is the date on the vote. 3/13/2008. Seems like somebody should have said something about htis before. Or are things just really SLOW in OK?

Florida should pass this resolution ASAP to stop the Commie Cuban/Chinese from stealing its oil in the waters between Key West and Havana. Florida maintains that it has a 120 mile off shore oil drilling zone. With the Cubans and Chi-Comms drilling only 60 miles from Key West that rig falls within the 120 exclusionary zone and should be shut down or taken over.
It is time for Governor Crist to show that he has something more than a good tan, and that he is a leader.

Wouldn’t get too excited folks; this was introduced into the Oklahoma House on MARCH 13th. It got referred to the Senate Rules Committee upon passage, where it’s been since March 25th.

If that’s true and this plays out, that MIGHT just be enough to make me vote for him. Normally, I don’t vote for libs under any circumstances, but I do understand the significance of the 10th amendment.

However, I have my doubts. We have one group here trying to reestablish the primacy of the states, and another group trying to diffuse even the concentration of power in DC to supranational alliances. McCain’s immigration position belies his loyalties.

If we get bogged down in the one-issue border thing again and let the Marxists in, the border problem is going to drop way down on the list of our problems...

Bedsides the obamama's puppeteers pulling the rug out from under our troops, and thereby US...besides their STATED goal to dismantle our military, besides their zeal to take our guns, besides Universal Health care, besides even late-term AND live birth killing, besides redistribution of wealth (not just in the U.S. = but from our pockets to the poor of the world...keep those thermostats down, no SUV's, "can't eat as much as you want to" - Dear God, does no one LISTEN to what they are saying? - besides Reparations and the stated goal to "rebuild Africa" etc etc...the flood gate for Muslims will be opened wide - particularly from Africa, starting with Kenya.

What part of all that don't people understand?

What part of being plunged into Marxism don't people understand? There will be no "If we let them in now, THEN the pubbies will listen to us and we'll have the conservatives we want in 2012. You don't GET to choose under Marxism. And it will be decades, if ever, before the country - maybe our great-great grandkids - will be able to crawl out from under it.

Yeah, do a repeat of the 2006 election mantra: vote the pubbies out of office to teach them a lesson...and recoup in 2008.

That worked out well. That gave us Reedy-boy and Peeeelosi. And where are all our uber=conservatives chomping at the gate this election?

Oklahoma’s legislature adjourned a couple weeks ago with the bill sitting in the Senate Rules committee. Don’t think it goes back in session until Feburary. I’ll check.

This thing doesn’t even declare sovereignty. Look what it actually says:

“THAT this serve as Notice and Demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers.”

So, Oklahoma is politely asking the federal government to please cease and desist. No mention of any way to enforce its “sovereignty”.
