Editorial: Local schools, local control ( TABOR vs Gov. Ritter )
Vail Daily ^ | June 10, 2008

Posted on 06/21/2008 2:40:05 PM PDT by george76

In Colorado, taxpayers have a tremendous amount of control over their own property taxes.

Thanks to the state’s Taxpayers Bill of Rights (TABOR), which stunts the growth of property taxes, those of us who own property in Eagle County shouldn’t expect to see our taxes skyrocket at the same rate as our property values without voter approval.

This year, however, taxpayers’ rights were usurped by Gov. Bill Ritter’s decision to freeze the statewide school district property tax rate...

Not only was Ritter’s move a clear violation of the TABOR Amendment because it effectively raised taxes without voter approval, it didn’t benefit many of the state’s school districts.

Gov. Ritter deserves to be chastised for violating the state’s own tax laws. But he should pursue changing the way the state funds education by proposing — and placing on a ballot — a measure that would give local voters more control over local schools.

No, he should be impeached and jailed for failure to follow the law, just like everyone. Anybody remember a little document called the Magna Carta, signed in England in 1215 AD? It was all about some silly little concept of the lords being subject to the same laws as the rest of us. It would be interesting to see the results if there were some way we could force the Democrats to take a stand on the Magna Carta today.

I'm so out of step with modern times that I think everyone should have to obey all the laws, especially if they supported them, passed them or are even just charged with enforcing them. Stupid me.

Now if all property owners could vote on whether to raise their property taxes, a large percentage of property in Eagle County is owned by people whose official residence is somewhere other than Vail.

No taxation without representation.

Actually, you are right.  Impeachment in Colorado is broader than nationally because it includes malfeasance in office.  The problem here would be twofold.  The Democrats control both the CO House and Senate, and the Republicans don't have the guts to do it.

 FYI

ARTICLE XIII

Impeachments

Section 1.  House impeach senate try conviction when chief justice presides. The house of representatives shall have the sole power of impeachment. The concurrence of a majority of all the members shall be necessary to an impeachment. All impeachments shall be tried by the senate, and when sitting for that purpose, the senators shall be upon oath or affirmation to do justice according to law and evidence. When the governor or lieutenantgovernor is on trial, the chief justice of the supreme court shall preside. No person shall be convicted without a concurrence of twothirds of the senators elected.

Section 2.  Who liable to impeachment judgment no bar to prosecution. The governor and other state and judicial officers, shall be liable to impeachment for high crimes or misdemeanors or malfeasance in office, but judgment in such cases shall only extend to removal from office and disqualification to hold any office of honor, trust or profit in the state. The party, whether convicted or acquitted, shall, nevertheless, be liable to prosecution, trial, judgment and punishment according to law.

As amended November 6, 1990 Effective upon proclamation of the Governor, January 3, 1991. (For the text of this amendment and the votes cast thereon, see L. 90, p. 1861, and L. 91, p. 2033.)

Section 3.  Officers not subject to impeachment subject to removal. All officers not liable to impeachment shall be subject to removal for misconduct or malfeasance in office in such manner as may be provided by law.

This seems to be the thing about the Democrat Party- even if one is initially a sensible, well-meaning person, spend too much time there, they’ll go off the deep end. Bill Ritter is an example of that.

The voters wanted a Democrat for Governor. Now live with it. Maybe next election the voters will think. Maybe.

Of course, Auggie might’ve been bull$hitting folks all along into buying his “moderate” schtick. The CO GOP ought to be working overtime to exploit their good fortune in having this rodent moonbat Governor to reclaim the majority that should never have been lost.

Bill Ritter has moved so far left, it’s unbelievable.

I suspect he was there (far left) all along. Like most DemocRATS, he ran as one thing to be elected, but now he is paying his dues to those that financed his election.

When will people learn there is no such thing as a conservative DemocRAT? If they were conservative, they would be Republican...although it's hard to even find conservative Republicans any more.

How about Senator wannabee and BoulderBoy Mark Udall (D) suddenly voting FOR the Iraq-Afghanistan supplemental this week!

The well-heeled liberals in Vail want to pay higher taxes. I don't.

Eagle County is home to Colorado's swankiest ski resort towns. Their residents vote consistently Left.

I've been working a lot this week and MISSED that tidbit of news!

Hmmm...is it to "appear" centrist, or was it the extension of unemployment benefits that swayed his vote?

I remember Salazar campaigned as a conservative, and many Republicans voted for him because they refused to vote for a "beer" man. HUGE mistake...

With regard to how liberal people are Vail is much better than Aspen, my family goes back in Eagle county before there was a Vail. I just want to be able to vote on local issues wherever I own property.

The problem is Ritter had never been elected to anything but DA so nobody knew what he really stands for. The Dems cried crocodile tears about him being "pro life" to fool conservatives into thinking he's more conservative than the average Dem. He also played the chamber of commerce types for fools, claiming to be pro-business. He repaid them by opening up public employees for unionizing and trying to make Colorado a close-shop state.

But right now I don't see anybody on the Republican side who could unseat him.
