Justice Antonin Scalia: Al Gore to blame for 2000 US election mess

The 2000 presidential election debacle was the fault of Al Gore, who should have followed Richard Nixon's 1960 example and conceded without legal action, according to the Supreme Court's leading conservative judge.

The 2000 election remains a source of discontent for Democrats

"Richard Nixon, when he lost to [John F.] Kennedy thought that the election had been stolen in Chicago, which was very likely true with the system at the time," Justice Antonin Scalia told The Telegraph.

"But he did not even think about bringing a court challenge. That was his prerogative. So you know if you don't like it, don't blame it on me.

"I didn't bring it into the courts. Mr Gore brought it into the courts.

"So if you don't like the courts getting involved talk to Mr Gore."

Justice Scalia insisted that his controversial decision, along with four other justices, to stop votes being recounted in Florida because the method was unconstitutional and it was too late to consider other options was "absolutely right".

He was speaking during an interview about his book Making the Case: The Art of Persuading Judges.

A strict "textualist", he rejects the notion of a "living constitution", arguing instead that the original intentions of its framers should be closely adhered to.

Once a voice in the wilderness, Justice Scalia now often finds himself in a narrow majority on the Supreme Court, such as in a landmark gun control case in which he wrote for the 5-4 majority that the framers of the constitution believed in individual gun rights.

I have said this ever since the 2000 election. Al Gore is responsible for the extreme hatred that grew from that recount process. He led a cause where he promised to undermine Bush as long as he would be in office and would go beyond protocol and let these radical leftists take over the party and the media.

That is what was going to happen anyway had he won in 2000. But he didn’t and we have seen nothing but extreme divide ever since. The bastard is indeed to blame.

I agree, and probably also for the unfounded resentment against Bush that was the seed of BDS. He also set the pattern for the Dems challenging any election in which they thought there was any possibility of their manipulating enough votes to win (as in Wash State).

I'm sure Barry is planning his ballot-box shenanigans even as we speak. In fact, they were probably planned months ago.

No question. About 2 years ago on FR I did a big post on this very thing. The country STILL has not rested as the maniacs from the mental hospital are still running the show for the DNC. The Howard Dean’s of the world, Soros, Michael Moore...etc...you betcha...Al Gore lined him up with every single person who thought he had the election stolen from him.

It was extremely obvious at the time what was going on and whose fault it was. I remember being really boggled (first time I ever really understood the word) that the rest of the world seemed clueless to the ridiculous charade.

No. BDS would have flourished no matter what. It's the left. There was a slightly conservative president. That's what the left does.

I agree! I remember watching the TV when the Supreme Court made their ruling on the election and I thought that the libs were going to use this to divide the country. And they have been at it ever since, with the help of the fully complict drive by media!

Just for clarification: it was the rogue Florida court that started the mess. Gore didn't do anything to dissuade them.

Gore, at the time, appeared to be ready to concede in advance of Harris' pronouncement. Gore took full advantage of the timing of the court's interference and changed his tune toot sweet.

The Gorebots will tell you that Bush was the first one to petition the court. He had to to protect his victory.

Hey, this could be the start of a new catchphrase. We've all heard "It's Bush's fault." Now thanks to Scalia, we can all start saying (for every occasion): "It's Gore's fault!"

I'm not sure anyone is running the show at the DNC. The Wall Street Journal had a good article about it yesterday. The Democratic convention planners are buying swag for all of the delegates, but they're having trouble finding stuff that actually panders to their combined special interests.

For example, they want to give each delegate a cloth bag to carry stuff, but it must be: made in America, by a union shop, with organic cotton. No such thing exists because the Democratic unionists don't care about the Democratic environmentalists, who don't care about the trade protectionists, etc.
