Greenpeace ruling overturned ( criminal negligence reinstated )

A Ketchikan jury correctly convicted a Greenpeace ship's captain of criminal negligence for sailing in Alaska waters without the proper oil spill response plan, the state appeals court ruled Thursday.

The opinion partly cancels a 2005 decision by a Ketchikan judge to overturn guilty verdicts against Greenpeace Inc. and Arctic Sunrise Capt. Arne Sorensen of misdemeanor charges.

At the time of its anti-logging campaign, the ship was carrying more than 70,000 gallons of "petroleum products," according to district court documents. In Alaska, non-tank vessels larger than 400 gross tons must file an oil spill response plan application five days before entering state waters. The Arctic Sunrise was almost 1,000 gross tons.

In its May 2005 verdicts, the Ketchikan jury convicted Greenpeace of two counts of operating a ship without spill contingency plans In its 24-page ruling, the appeals court directed the lower court to reinstate the jury's verdict that found Sorensen guilty of operating the ship without the contingency plan on July 14, 2004.

The environmental activist group, the captain of the Arctic Sunrise and the ship’s agent all are charged with misdemeanor criminal counts of operating a vessel without a spill contingency plan or proof of financial responsibility in case of a spill, as required by state law.

The chief operating officer of Greenpeace Inc. said her organization bears no responsibility for a ship that operated under the organization’s banner in Alaska waters without a spill prevention plan.

‘’It is Stichting Marine Service’s responsibility,’’ McPeake said.

McPeake described the ownership of the Arctic Sunrise and two other ships commonly associated with Greenpeace, as well as how the ships are used by 30 independent Greenpeace organizations around the world.

The ships are owned by Stichting Phoenix, of Amsterdam, and are leased as bare boat charters to Stichting Marine Services, she said. The public is uninterested in the corporate ownership of the ships commonly associated with Greenpeace and Greenpeace groups do nothing to dispel the belief that the ships are owned by Greenpeace, she said.

Stichting Marine Services takes on all aspects of operations, including hiring captains and crews, equipping the vessels and maintaining legal documents, she said. The company then leases the ships to Stichting Greenpeace Council, the governing body of Greenpeace International, at no charge, McPeake said.

It sounds like Greanpiece is hiding corporate responsibility behind a shell corporation to avoid any legal liability in case of accident.

Wouldn't want mummy's trust fund babies to suffer an accident, and then use the remaining trust fund to sue Greenpiece, so that their finances were opened up to the world.

The loony left is nothing but lying fascist commies.

So the governing body shares the same name, landlord, office space and legal team ...

If Stichting leases the boats and crews back at no cost, HOW are they funding operations?

They can try to hide behind the different name but, under the Oil Pollution Act of 1990, the ultimate owner is responsible for violations of the law. Greenpeace would like the court to run into a blind alley but its not going to work.
btw, under OPA-90, in certain circumstances like an oil spill, negligence or a deliberate act, conviction carries UNLIMITED LIABILITY in damages to the state.
