A New Jersey woman has sued her orthopedic surgeon after awakening from surgery to find a temporary tattoo below her panty line.

Elizabeth Mateo, of Camden County, N.J., filed her lawsuit Tuesday saying she found "a temporary tattoo of a red rose" below her panty line the morning after her surgery for a herniated disc, her attorney, Gregg A. Shivers, told the Philadelphia Inquirer.

"She was extremely emotionally upset by it," Shivers told the paper.

Not smart on the part of the doc, at all. Unprofessional.

That being said, award the woman a paper towel, and some warm water for her pain and suffering.

After my spinal fusion surgery (removed herniated disk) I was too sore to notice anything. Plus the brace I had to wear to support my spine does not allow you to see your panty line.

Is this sturgeon some kind of a nut bag or what?
What was he thinking?
What did he expect would be the outcome of his actions?

Creepy, unprofessional, and violation of “boundaries.”

inexcusable, and should be stiffly disciplined.

Some people are emotionally fragile, unlike all the tough-guy Freepers here.

The moral equivalent of making dirty leering jokes while examining a lady with a speculum.

I can also tell you that if it had been my Mother, she would have been genuinely traumatized, and I would lead the fight to sue the doctor for all he was worth to set an example.

“ the doctor has left washable marks on patients before to improve their spirits as they heal”

And most would take it that way...but he should also understand that a rose tattoo under the panty line might be disturbing to a lady.

(No harm no foul. She’s trolling for dollars, methinks.)
On what basis do you assume no harm?
Would YOU want some doctor or nurse writing on your body without your knowledge?

1. The Physician had permission to work on the woman's back.
2. He did not have permission to touch her anywhere else.  This was a clear violation of ethics.
3. Most people consider the region that would be under their underware, to be private.
4. You try touching a woman there without her permission.  See what you get for your efforts.
5. If this physician was free to touch this woman there, where else might he have touched her?  He opened up a whole can of wham when he did this.
6. The hospital states, "We could find no witnesses."
7. If the hospital cannot find witnesses, it is even more troubling.  Is this physician left alone with female patients to do whatever moves him?
8. The physician has just completed an operation on the woman's spine.  So what does he do?  He rolls her over to rub a temporary tatoo on her under where her panties would be.
9. If I were this woman's husband, I'd be tempted to go over to this idiot's home and give him a refresher course on patient's rights.
10. If this guy wanted to put a temp. rose tatoo on the woman, why not put it by the work he just completed?  What was the need to put it close to her groin on the other side of her body?
11. Where was the anethesiologist?
12. Where was the nursing staff?

When I had my spine fused, they went through my stomach to remove the disk and put the metal cage in, then they go in through the back to put the screws and stuff in.

I have a scar front and back.

I think the thing that’s being missed is that it was a washable marker. A wet washcloth would remove it. Immediately. There are so many serious things in life that I just don’t see a washable rose as one of them.

I’ve never had surgery so I don’t know, but don’t you have to remove ALL your clothing and put one of those surgical gowns on? Maybe he thought he was putting the marks above the panty line but missed due to the fact that there were no panties there?

You're braver than me! I have scoliosis and 2 herniated disks in the lumbar spine....right in the middle of a curve. And there they will stay. I know a 20 something young lady who had surgery and she's worse now.

Did yours help?

Shivers, who practices in Cherry Hill, would describe his client only as a clerical worker in her mid-30s with a husband and young children.

All good questions.

And reasons I think the woman has a right to sue.
