Who would be his replacement if he were constitutionally ineligible would be insignificant. Upholding the constitution would be the vital issue no matter the results.

We don’t apply it only when we like the results.

Bingo. That is correct. I grew up with friends who were born in Africa to an American mother and a Canadian father. While US naturalized citizenship was easy for them to obtain, they were not considered “natural born.”

Please keep in mind that I am only dealing with the ability to run for office. If Obama were elected and then found to be ineligible to be President, he could not be sworn in and the person elected Vice-President would then become President (25th Amendment, I think). Bill and Hillary may be thinking of such a scenario.

I suspect this is all about something less grand: Did Barack dump his Indonesian fathers name and "readopt" his birth name of "..Hussein Obama"so that he could have better entre into the world of African-American radicalism? Not a disqualifier, but nonetheles embarrassing, in that it makes him look all the more like a poseur.

Congress decreed in 1790 that “...the children of citizens of the United States that may be born beyond the sea, or outside the limits of the United States, shall be considered as natural born citizens...”

In other words, the term “natural born” at the time of the US Constitution’s writing meant someone who was born inside the US. As time went on, as with this 1790 law, it became necessary to include exceptions as “natural born.”

There are a couple of issues with Obama, but if he was born in the US, then he is a natural born US citizen.

1. Without a birth certificate, there is no proof that he was born in the US.

2. Without a DNA swab, there’s no proof that the woman he calls mother is his mother.

3. This article suggests that sister Maya was born in Indonesia and that someone had fabricated a birth certificate for her.

Perhaps this is the bombshell (and NOT the “whitey” rumors) that the Clinton campaign had during the primaries - but was absolutely afraid to use against Obama.

I sense that whatever information that the busy conservative bloggers are working on, the Clintons already HAVE, and in spades.

For that answer, I refer you to the Law of Nations, which is contained in Article 1, Section 8, Clause 10 of the US Constitution.

The specific clause says: To define and punish Piracies and Felonies committed on the high Seas, and Offences against the Law of Nations.

Now, the clause (sub-clause, actually, if that) says nothing about the U.S. being bound by the "Law of Nations" -- and, indeed, we are not. The clause (if you really want to call it that....) does nothing more than authorize Congress to "define and punish ... Offences against" it.

Further, it's pretty clear that the "Law of Nations" does not refer to any specific body of internationally promulgated law; rather, it is more a reference to a set of philosophical principles -- which is why Congress was given power to define offenses against it. A good discussion can be found here. In particular:

In the debate on the floor of the Convention, the discussion turned on the question as to whether the terms, ''felonies'' and the ''law of nations,'' were sufficiently precise to be generally understood. The view that these terms were often so vague and indefinite as to require definition eventually prevailed and Congress was authorized to define as well as punish piracies, felonies, and offenses against the law of nations.

It is, further, quite clear that the context of the term as used in the clause you cite is much different from any questions of Obama's citizenship.

Maya Kassandra Soetoro was born in Indonesia but having US citizenship is very valuable in the world. Maya’s mother was American so perhaps obtaining a US birth certificate makes sense.
