A state appeals court has reinstated a lawsuit challenging a policy that allows some illegal immigrants to pay lower in-state tuition to attend California's public colleges and universities.
The 3rd District Court of Appeal in Sacramento said Monday that a lower court erred in dismissing the suit brought by 42 students who paid far more to attend college because they were out-of-state residents.
At issue is a 2002 law that made any California high school graduate who attended at least three years of high school in the state eligible for in-state fee breaks, regardless of immigration status.
Because they are willing to take advantage of stupid Americans.
So that Democrats can justify counting them in the census because we’ve “invested” in their education.
I moved to California last year from another state, and thus, had to wait one full year to become an in-state student. I was actually at the residency desk (they combine it with “international students” desk) and had to wait over twenty minutes to get someone who barely spoke English to look over my documentation. Nice to know that someone who came here illegally takes precedence over someone who played by the rules.

In fact, McCain’s Illegal Alien Amnesty Act of 2007 would have removed the Federal law that prohibits states from charging one group of non-residents less than other non-residents.
Sad that judges would refuse to hear a case when the plaintiffs already have Federal law stating that what happened to them was illegal.

It’s California’s Mexican Assembly and Senate.n They prefer illegals to citizens.
My daughter transferred from AZ to CA a year ago and is STILL trying to get in-state tuition. We also asked about academic scholarship money as she was 3.4 or higher all last year combined and made the CCAA Academic Athlete Award list...they said they didn’t know yet! ALl the paperwork she’s had to go through and we’re still not sure if she’s paying out-of-state tuition... her softball coach has promised to help,and has been running down all the possibilities.
Finally. American students should be filing these kinds of lawsuits all over the country, anywhere where illegals are given instate tuition (Maryland comes to mind) and lawful residents of other states aren’t. I think the Equal Protection Clause speaks to this.

(b) Effective date
This section shall apply to benefits provided on or after July 1, 1998."
What’s to stop anyone from walking up to the desk and saying “I’m an illegal alien- registrer me”
