Dan Rather's $70 million lawsuit against CBS is getting whittled down like a redwood at an Alabama beaver party.
A Manhattan judge yesterday threw out two more of Rather's claims against the network, including his charge that his former bosses committed fraud by falsely promising to help restore his reputation after he became a "scapegoat" for a discredited story about President Bush's military career.
"We are extremely gratified that the court has now dismissed the vast majority of Mr. Rather's claims," CBS said in a statement.
Rather's lawyer, Martin Gold, said that despite Judicial Hearing Officer Ira Gammerman's ruling striking down two of their remaining four claims, their suit is still alive.
"The whole story is coming out," he said, predicting that Rather will prove claims that he was railroaded by his longtime bosses so they could curry favor with the Bush administration.
Rather filed suit against CBS last year, charging they hung him out to dry after the uproar over a flawed story on the president's days in the Texas Air National Guard.
The report, which aired during the 2004 presidential race, said Bush avoided Vietnam by pulling strings to get into the Guard, and then shirked his duties once he was in.
The story came under fire when some of the documents the report relied on were revealed to be forgeries.
The suit maintains the story was accurate but the network forced Rather to apologize for it.
Network honchos decided to ax him in order "to pacify the White House," the suit says.

And, in an unusual move, the judge penned a rationale for the dismissing the claims. It was single question, "What's the frequency, Kenneth?"
Dan hasn’t been roughed up like that since the 68 Democratic Convention.
Redwoods in Alabama? Hmmm. I don’t think the metaphor is accurate. But at least it isn’t fake.
CBS will have to pay damages in the amount necessary for cab fare to take Rather to the nearest Greyhound Bus station. The ticket back to Texas not included.

I had no choice but to post it when I read that line. The NY Post is the best, and the worst, newspaper in the history of journalism. Danny boy should send them his resume (which probably says that he went to Yale and Harvard Business School).

I can easily envision a redwood being trucked to a beaver party in Alabama. Much like ice cream from Wisconsin would be trucked to a banana split party in Arizona. No?
As I sit here trying to accomplish other things, I keep giggling as this pops into my head. I have a feeling it’s going to stick with me the rest of the day.
Dan’s lawyers have found some important new evidence, and are faxing it to the judge from the Kinko’s in Abiline, Texas as we speak....

This fellow is existing in some kind of alternate universe. In this one there is no media that has yet tried to curry favor with the Bush administration.
What’s the Frequency Kenneth?
Dan’s case is as thin as turnip soup. He’s rapidly reaching the point where he’s got his back to the wall, his shirttails on fire and the bill collector’s at the door. He would rather walk through a furnace in a gasoline suit than consider the possibility that could lose this case.
Dan’s case is shakier than cafeteria Jell-O. He doesn’t know whether to wind his watch or bark at the moon. But his a$$ is as tight as the rusted lug nuts on a ‘55 Ford.

Rather seems still to be fighting the Bush Administration — what a pathetic loser he is! And to think that he held the spotlight at CBS for so many years! Oh, dear.
His case is falling apart faster than Sh#t through a tin horn.
This is a great story and battle. If Rather wins, then CBS loses, and I am happy. If CBS wins, then Rather loses, and I am also happy!
