my understanding was that this was simply the prepared document provided by berg, not an actual decision of the court...
... is this really the case, that the motion was actually denied? if so, day 3 would be tomorrow, 10/2.

(1) get us all excited, then produce the goods; or
(2) they don’t have the goods
