my understanding was that this was simply the prepared document provided by berg, not an actual decision of the court...

I had not heard that, was just reading through the actual document and didn't catch that. RATS......thought this was going somewhere and the judge HAD responded.

I believe you are reading this wrong. This is plaintiff’s proposed order denying the motion to dismiss that accompanied his brief in opposition to the defendants’ motion to dismiss.

That appears to be the Propsed Order that Berg submitted with his opposition papers.

It doesnt look like a signed copy by the Court.

But if you see a signed copy, by all means please post it.
