US judge orders Chinese Muslims at Guantanamo freed 07 Oct 2008 16:40:00 GMT Source: Reuters WASHINGTON, Oct 7 (Reuters) - A federal judge on Tuesday ordered the release in the United States of 17 Chinese Muslims who have been held at the U.S. military prison at Guantanamo Bay, a landmark ruling that dealt a major setback to the Bush administration.

U.S. District Judge Ricardo Urbina read his ruling from the bench at a hearing to consider the appeals by the members of the Uighur ethnic group, who are seeking their release from the military prison and and asking to come to the United States.

The judge said there was no evidence the detainees, who have been held at Guantanamo for nearly seven years, were "enemy combatants" or a security risk, and that the U.S. Constitution prohibits indefinite detention without cause.

The ruling was a setback for the Bush administration, which argued that federal judges do not have the authority to order the release into the United States of the detainees.

Judge Urbina was appointed to the United States District Court in July 1994. He received a B.A. in 1967 from Georgetown University and graduated from the Georgetown University Law Center in 1970. He served as staff attorney for the D.C. Public Defender Service from 1970 to 1972 and then entered private practice. From 1974 to 1981 he taught at Howard University Law School and directed the University's Criminal Justice Program. He was appointed Associate Judge of the Superior Court of the District of Columbia in April 1981, and served as Presiding Judge of the Court's Family Division from 1985 to 1988.

“The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it. “

Does the Constitution apply to non Citizens? I’ve always felt the answer is “no” - otherwise we could arrest people like Ahmadinejad when they come here for treason.

Mr Journalism major, let me be the first to inform you that the mere fact that a judge made a statement does not actually mean that the issue of whether he has the authority to issue such a statement is settled.
