US judge orders Chinese Muslims at Guantanamo freed 07 Oct 2008 16:40:00 GMT Source: Reuters WASHINGTON, Oct 7 (Reuters) - A federal judge on Tuesday ordered the release in the United States of 17 Chinese Muslims who have been held at the U.S. military prison at Guantanamo Bay, a landmark ruling that dealt a major setback to the Bush administration.
U.S. District Judge Ricardo Urbina read his ruling from the bench at a hearing to consider the appeals by the members of the Uighur ethnic group, who are seeking their release from the military prison and and asking to come to the United States.
The judge said there was no evidence the detainees, who have been held at Guantanamo for nearly seven years, were "enemy combatants" or a security risk, and that the U.S. Constitution prohibits indefinite detention without cause.
The ruling was a setback for the Bush administration, which argued that federal judges do not have the authority to order the release into the United States of the detainees.

WTF?
Then we will just let them move to the judges city and get a job at one of the many chinese fast food joints in town. I hear he likes sushi, mohammed(Hot) style.
Does this idiot think anybody cares what he orders? Just ignore him.

Judge Urbina was appointed to the United States District Court in July 1994. He received a B.A. in 1967 from Georgetown University and graduated from the Georgetown University Law Center in 1970. He served as staff attorney for the D.C. Public Defender Service from 1970 to 1972 and then entered private practice. From 1974 to 1981 he taught at Howard University Law School and directed the University's Criminal Justice Program. He was appointed Associate Judge of the Superior Court of the District of Columbia in April 1981, and served as Presiding Judge of the Court's Family Division from 1985 to 1988.
Yeah, let’s set em up with sub prime mortgages in Manhattan and D.C. —— and while we’re at it, let’s give em jobs with Homeland Security.....

Great - so not only are these people being let out, they’re being released amongst us. Wonderful.

Does the Constitution apply to non Citizens? I’ve always felt the answer is “no” - otherwise we could arrest people like Ahmadinejad when they come here for treason.
>>>The United States has been unable to find a country willing to accept the Uighurs.<<<
No one wants these Islamic pacifists? Why is that?
Now they can go back to working as "community organizers."
Mr Journalism major, let me be the first to inform you that the mere fact that a judge made a statement does not actually mean that the issue of whether he has the authority to issue such a statement is settled.
we are so screwed......
One of the things I learned in kindergarten was to put things back where I found them. Just put these guys right back in Afghanistan. The part that borders China, of course.
1. Go read up on the Laws of War.
2. Realize that you have no jurisdiction over matters of war.
3. Take a flying leap at a rolling donut.
Thank you.
They want Asylum. That means they can go right on Welfare.
Set them free and drop them off at the Peiking AP.
Bush to Judge: Stick it in your a$$.
Flee Musrums!!!!
Put para chutes on them and jettison them over China...China
doesn’t like chinese Muslims!
Please tell me you got this from Scrappleface?
Or if not: could we get them released into Nancy Pelosi’s custody?
I hear her restaurant needs some more dishwashers...
What jursdiction does he have?
Or better yet, just economize on parachutes...
Um, so can we just kill these non-uniformed combatants out in the field like the Geneva Conventions allow and forget about detaining them over here? With our interrogation techniques continually being eaten away, I can’t imagine there’s any info all but the top guys could provide that would be valuable than these idiotic trials and rulings are damaging.
Put the chinese terrorist on a military transport to Tiawan, then have them flown commericial to Beijing.
Let China deal with them. They will likely be dead and body parts within a week.
Don’t forget to register them to vote for 0bama in the election.
Judge Urbina at best you are stupid. At worst you’re a stupid traitor. I wonder what you’ll say if one of these terrorists blows up someone you love. Oh, oh, what must I be thinking? You will blame George Bush not the bomber, of course. You’re a pathetic excuse for an American.
WTF. This is a case where the executive branch must ignore and castigate this judicial retard.
I say ignore him...he has overstepped his authority.
President 1993-2001, William Jefferson Blythe Clinton.
So this clown was one of The Bent One's early judicial appointees.
Notice this story has no mention whatsoever of the circumstances of the capture of these men. That makes me think it was probably pretty obvious that they were indeed “enemy combatants”.
Imagine my surprise.....
We can’t deport these guys: they might vote Democrat.
Obama carries the terrorist vote...
It also states that they where captured at Tora Bora, Osama's former hideout. I'm sure they were just herding goats or farming. Riight.
Registration is closed in most places, and definitely is in DC. Of course the judge could "bend" the law a little, in the interest of "justice", (and hope, and change).
