Berg’s case is in federal court, too, not state court. Both cases were civil cases. The only difference is that Berg is a vexatious litigant with a patently baseless lawsuit. The Ohio Republican Party was not.
What, the FEC needs it in a fed court when it’s a civil case?
At any rate, the FEC moving ought to get this some legs?

I see Berg's error now. This needs to be a Federal Case.
One thing the judge can do if I’m not mistaken is order discovery pending his decision on the motion to dismiss. If he were to do that the public would still get the facts even if Berg ultimately loses the case for lack of standing.

I’ve been trying to explain this to a friend of mine who’s supporting Obama. She gave me this website that supposedly “proves” that Obama’s Birth Certificate is genuine. I obviously don’t understand this well enough to refute what’s on factcheck and would like someone to help me explain it to her. Here’s the link

You need to read the post I was responding to. FYI: There were all kinds of speculation last night on various threads speculating what was wrong with the grandmother and how serious her condition was. Some posited that she was on death’s doorstep and under hospice care at home. Now we know that she broke her hip.
Just tell her the one on factcheck has been photoshopped and altered several times according to several experts. But even if she refuses to believe that what they have is a Certificate of Live Birth and is not the long form that would state the hospital where he was born and the doctor who delivered him. That’s what is being demanded right now with the lawsuits against him.

Assuming an O victory, the only basis for not installing the president-elect when Bush’s term ends would seem to be that he has failed to qualify, not that he may be disqualified.
O will not play games, he and his legal team and his handlers have already crossed this bridge. O could satisfy the burden of qualifying at the last moment by offering evidence of a BC together with expert testimony as to its authenticity, etc.
It could be months before the BC was determined to be counterfeit, if in fact it is, and if a thorough investigation was permitted.
Based on the views of more qualified posters, it does not appear the case will mature by Jan 20 to provide merit to a stay by the trial court.
Given the 5-4 Bush v Gore decision and the 5-4 Heller decision, I hope our nation is spared any USSC review.
