I’m an attorney and this happens all the time. Judges require the parties to often submit draft orders along with their motions.

And the other side always has an opportunity to be heard before a motion for Summary Disposition is granted.

sorry but every motion in a Federal Court has to be submitted with a proposed Court order which the Judge will use if granting the motion.

Until you see a motion with the date and signature on file then the proposed Order is just that—proposed.

This summary judgement motion is probably not going to fly before the election because the time span for the defendant to reply is 30 days from filing, not counting holidays.

Berg is dreaming if he thinks this is going anywhere after filing so late in the day. The Court will move with all deliberate speed in order to avoid getting tangled up in the political process.

In fact, this is filed so late in the election campaign that I can only assume that Berg simply wants some publicity.

Again, I’m all for bringing forth actual evidence and proof that Obama is not what and who he says he is. I would LOVE for the judge in Philly to rule in Berg’s favor and force Obama to produce a COLB. That’s one thing. Posting links to porn shots of his mother (whether it is or not) is wrong. It really has no revelance. It is simply added for purient interests. I can’t believe this thread has lived this long. FR may come to regret allowing it to so do. Just as McCain may be gaining ground, the MSM could splash this and get Nobama a bunch of sympathy votes. Wouldn’t that be just peachy. I know you didn't make it up. The information about Berg's lawsuit has been posted here MANY times. We're all waiting for a ruling from the judge and then you post this leading some to believe that he made a ruling when in fact he had not. There's no new news there.

What I'm saying is you need to use some discretion. Just because you read something on some other blog, doesn't mean you should rush over here to post it. I think the links to those pictures is in VERY bad taste. If KOS or DU was doing something similar, we would be outraged. Don't be like them. Are you able to make your case without posting porn pictures or links to porn? I think so. And you can't get off by saying "it wasn't ME that posted the links, it was someone else's story that I posted". Either way, you are posting it. IF the MSM media decides to do a "hit job" on FR, you will see what a bad idea it was.

I noticed that the story implies Berg/his lawyer wrote the order himself, hoping that the judge would sign.
If the judge is a repubbie appointee, we “might” get a fair case - until it is appealed to a Clinton-Carter judge at least.

I believe you have it backwards. When I search for Obama Sr in pictures, I get the picture on the right.

Note Obama SR has a forehead and chin like Jr...particularly the square forehead.
