i may be wrong here but speaking from my experience the plaintiffs lawyer in this case berg usually supplys the motion...??...if it is entered correctly and the court approves it is signed at that time....

IMHO there is no way the judge signed this proposed order for summary judgment. In simple terms... a summary judgment requires that there is no possible reasonable dispute on the facts and eventual outcome even after accepting the allegation of the other side as true. That’s not the case here. Team Obama hasn’t produced the documents that could maybe support an SJ against them. An SJ ends the case without finishing the trial. That only happens when it’s proved there can only be one outcome. That takes evidence the Court doesn’t have yet.

On the practical side... no judge is going to disqualify the front running candidate without a full blown trial on the matter. In fact, the Court is likely looking for any reason to get rid of the case.
