Director Fukino says that she has personally seen Obama's original birth certificate.Wouldn't that constitute a breach in privacy without having the individuals permission to view the document?

No, it would be a breach of privacy if this official of the State of Hawaii did not (a) have jurisdiction over the records in question or (b) disclosed the contents of said records. She is within her statutory authority to view the record, but would violate the uthority entrusted in her by disclosing it.
