RICHMOND, Va.: Republican John McCain's presidential campaign sued the Virginia election board Monday, claiming absentee ballots weren't mailed on time to military members serving overseas.
The complaint asks the U.S. District Court in Richmond to order the state to count absentee ballots postmarked by Tuesday and received by Nov. 14. It contends that thousands of troops' ballots, many of which would go to McCain, will not be counted.
The deadline for ballots to be received is 7 p.m. Election Day, which is Tuesday.
The lawsuit is the second in a week to challenge preparations for the presidential election in Virginia, where Barack Obama hopes to become the first Democrat since 1964 to win the state's 13 electoral votes. Polls over the past week show him about even with or slightly ahead of McCain.
More than 436,000 new Virginia voters have registered since Jan. 1, and about 500,000 people, a tenth of the state's electorate, have cast absentee ballots.
A hearing on McCain's lawsuit is scheduled for 1:30 p.m. Tuesday before Williams.
That lawsuit alleges that ballots for overseas military voters were mailed too late to ensure they are returned by the deadline.
A 1986 federal law requires ballots to be mailed to military voters in foreign countries at least 45 days before the election, which this year would have been Sept. 20. The lawsuit alleges the state didn't have the ballots printed and sent to local officials by then, meaning they may not have been mailed overseas until October.

Too little, too late.
Why on Earth are the military ballots not counted? If anyone should have their vote counted, it’s those men and women sacrificing for our freedom.
In an aside, I had the unfortunate experience of hearing an AP news segment today. In one story they said ‘active military aren't supposed to be political when in uniform. This soldier couldn’t help voicing his support for change in Washington.’. What a surprise. AP was able to find one of the 20% supporting 0bama and use him in a news cast. Unbelievable.
This is a despicable outrage! THis is the SUPREME example
of disenfranchising the voters.....military at that.
What gross mismanagement by the state of Va. to not mail out ballots on time. Borderline criminal in my opinion....

The problem with this law, and many others (like requiring identity verification of campaign donors), is that there’s no mechanism for translating violations into a change in election results. Violations, if discovered and confirmed, pose no threat to the vote counts attributable to them. Millions of dollars in donations to Obama can be found to be illegal, and fines may be imposed, but it won’t change the election result. We really need a complete overhaul of our election system.
Because they won’t arrive by the absentee ballot deadline, because they weren’t sent out to the service members by the legally mandated date.

This started back when AlQaida terrorists who seized airplanes obtained VIRGINIA DRIVER'S LICENSES. They found it very easy to bribe the Springfield VA DMV personnel to provide them.
The Democrats have no will to do so or interest in preventing terrorist influence in Virginia government.

Not at all. Usually the lawsuits come after the polls close.
This is a pre-empt defense and sucks the Virginia news cycle outing the Dems disenfranchisement of the military.

The Presidential Campaign has been going on for over a year now. The date of the election wa certainly know.
There is no logical reason in the year 2008 that the men and women defending America do not get their absentee ballots in time to get their votes counted.
Sure does seem the last couple of elections that there is some actual effort to ensure the military does not get to vote.
Really. At the very least the GOP should have had a team in place for no other purpose than to see that each state sent out their ballots on time. Should never have been allowed to get to the point where a lawsuit was even necessary.
