This is nuts. The SPCA is a private organization. Since when are they authorized to be some sort of animal gestapo?

People come on your property without permission and THEY tell YOU to stop taping them. Something is wrong here.

I think it’s perfectly legal to tape & record folks on your property with or without their permission, you merely have to notify them you are doing so.

Do I have to notify people when I look out my window?

Banks and their ATMS allowed to record you and I didn’t sign any sort of consent or see any notification when going to a bank I am not a customer of.

In public there is no expectation of privacy, on private property is a different story. (Think of taping phone calls, they are not in the public domain.)

I am so sick of the common misconception people have. The Black Panther in Philly yesterday had the same misconception:

It is perfect legal to video or photograph people in public.

I believe the law allows you to videotape a person without notification but once you tape for audio you have to inform them, not get their permission.

Both the SPCA and the police are going to be on the hook for a civil suit. They had no basis to remain on the property without permission unless they had probable cause to believe that a crime was being committed. At most, the nosy SPCA guy suspected that the horses didn’t have shelter.

That officer had no grounds to arrest. The town of Candia, or more likely, the NH Municipal Association, will be looking to settle this at some point in the not-too-distant future.
