Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation: — "I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States."
Unfortunately, the Constitution does not specify WHO administers the Oath! Should the Chief Justice refuse to swear him in (tradition, not requirement), I'm sure Speaker Pelosi would be happy to do the job. Bouyed by a sympathetic-majority Congress, he would not be impeached as ineligible. Considering that Congressionally-passed bills become law after 30 days if left unsigned, even if his signature is invalid the bills still become law after a month (to wit: if he's not legally President, then whoever is/would-be legally President didn't veto it, so it becomes law).
Put simply: so long as he doesn't show that paper, he has the momentum to occupy the office. His opposition won't (he supposes) be able to stop him for want of an unseen paper that proves what most will consider a mere technicality.

Just for the record, some people think I am Leo Donofrio, the man who filed the NJ lawsuit. I am NOT. I merely posted his comments on this site from the Democratic disaster site. I should have made it more clear in my previous posts.
This needs to be solved now. BO is guilty of a high crime as are the democratic party if he is not qualified. If the supreme court drops this thing we have no country left.

My unsolicited $0.02 is that *if* a ruling by the SCOTUS is forced on this (and I doubt that it will be), then the election will be upheld, and the ruling will not be applied to any other case law, a la 'Bush v Gore'. Likely the best case scenario, AFAIC, would be to uphold the current election, then rule that Obama is ineligible to run in 2012, thus making him a lame duck before he even takes office.
And honestly, while I hate the idea of Obama in power, I hate the idea of a race war in the country even more. Completely tossing Obama out at this point in the game, is an invitation to total disaster, IMHO. Would make Rodney King look like Beach Blanket Bingo, only on a national scale. And, I'm not entirely sure that our nation would survive.
Doing something because it's right, doesn't always make it the right thing to do. Unfortunate that Obama's narissism, along with the Dem's willful blindness and lust for power, have put America in this situation.
Aren't we still a nation of laws as was stated by Obama concerning the potential deportation of his Aunt in Boston? I'm sure the Obama supporters would understand.
Yes we are. And that's why it pains me to take a position like what I have taken. However, I see trying to find a middle ground as a bad, yet more palatable alternative to tearing the country in half in a race war. Like I said in my previous post, sometimes it's more important to do the right thing, than to be right.
I blame the MSM and the current Dem power structure for putting the country in this position. Obama is not a simple dupe - he certainly is complicit - but frankly, he's just doing what I would expect a narcissistic power-hungry politician to do. When a dog pees on a Fire Hydrant, it's not being a vandal, it's just being a dog.
Hopefully, the SCOTUS will find a solution that prevents a Second Civil War from happening, while simultaneously preventing an act like Obama pulled from happening again. Judging by the treatment that previous cases have gotten, I'm not optimistic. I believe that there's a better than average chance the Court will do absolutely nothing, which is likely the worst of the "middle grounds" to find, IMHO.

It is a NJ attorney, therefore it is NJ news. The benefit with making them report it is that it is then heard in NYC and Philadelphia. That could be the stepping stone needed to getting it out nationally.
Especially since NJ has at least 3 politicians being considered for the Obama Administration. Most notably is our governor Jon Corzine, formerly of Goldman Sachs.
Lets call, email and fax them.

There is no middle ground and can't be if Obama is a foreign born usurper. We either have a race war to do the right thing and uphold the constitution, or we go into full fledged civil war as we fight for our freedoms against a usurper. No middle ground.
My question is, what kind of response is due Dec.1st from Obama. The actual documents or just another motion to delay or to ask that the case be dismissed? Will he actually have to produce his birth certificate and documents showing his US citizenship, not Kenyan or Indonesian citizenship?

If it were to happen that Obama is not sworn in, there no doubt would be some riots. However I believe the % of people who would riot would be small and most would realize that our Constitution must be upheld.
No what is really interesting is that you seem to have no problem with throwing away our constitution thinking that somehow everything will be ‘okay’ and freedom will prevail.
And what legal neutering are you referring to? If SCOTUS rules he is unconstitutionally qualified, but keeps him in power for 4 years we’ve just shredded the constitution. No one would owe any allegiance to Obama. I know I for one will stop paying taxes at that point.
If SCOTUS allows an illegal usurper to govern even for 4 years then the constitution means nothing, what’s to keep him from telling SCOTUS to go to h*** and setting up a complete dictatorship?

Now all that needs to happen is, the Supreme Court needs to hear the case. Then they need to prove his Hawaii b.c. is fake. Then they need to prove he was born abroad. Then they need to convince the Supreme Court not to overturn the INA of 1952 since it conferred more rights to 19 y.o mothers than 18 y.o. mothers.
Call me crazy for doubting it will happen.
I expect Obama to obfuscate, delay, seek dismissal, and say Berg has no standing. I doubt he will show any proof.
