A Plainview man awaiting trial for murder in a 2006 slaying outside a Manhattan nightclub now faces new charges: that he was drunk when his sport utility vehicle crashed into a cab in Queens yesterday morning, killing its driver and a passenger, New York City police said.
Daryush Omar, 24, was driving his white Range Rover west on 31st Avenue in Astoria at 3:10 a.m. yesterday when he collided with a livery cab southbound on 34th Street, a police report said. The cabdriver, Bessy Velasquez, 41, of Brooklyn, and the passenger, Panayiota Demetriou, 30, of Queens, were taken to Astoria General Hospital, where both were pronounced dead on arrival.

I believe everyone who hurts someone while under the influence of a self-inflicted recreational drug should be tried for their crime as though it was premeditated.
After all, if I willingly give up my ability to stop myself from behaving in a way I normally know is wrong, I’ve chosen to commit whatever comes afterward, too.

I heard this morning on the news (Fox) that he was here as an illegal alien and that he was given free reign after his first murder so if one is a citizen then he would be in jail but since this killer was an illegal alien he got out free and may also get out of this one the same way.

Diminished capacity, when voluntarily diminished, should be an exacerbating circumstance, rather than a ‘mitigating circumstance’, with commensurate sentencing enhancements.

Most states have the felony murder rule. That is, if someone dies in the commission of a felony, the felon can be charged with murder. His very presence here is arguably felonious since he was “on the lam” and avoiding prosecution for a crime which “I” would consider any prior flight to avoid prosecution. Bam, life in the graybar hotel of injection of nasty chemicals.
