Kmiec and others who dismiss the pro-life movement as misguided and futile also ignore the way in which the legal struggle over a 35-year period has kept the moral question before the public. If henceforth the principal way of opposing abortion is to offer alternative possibilities, it will cease to be a moral issue and will become merely one of a number of pragmatic solutions to a social problem. The role of pro-lifers in the Obama campaign was not to persuade the candidate to moderate his stand on abortion (there is no evidence that they even tried to do so) but to persuade pro-lifers to forget about the issue.

Outlawing abortion outright federally is not a winnable issue anymore and is constitutionally questionable anyway. Overturning Roe vs Wade slowly as the courts have done is defensible but is never properly explained except by Scalia. A federal ban on partial birth abortion and parental notification were winnable issues but bring up questions of federal power(which I am not that concerned with, but some may be) .
That being said GWB didn't give McCain much to work with politically(even with the surge) , and McCain was a crappy candidate short a foreign crisis just before election, but the whole economy implosion and the 900B bailout bill a few weeks before election doomed McCain for good, probably just as well.
