All who read the article will know that the agents did not commit the crime that they were charged with. Prosecution is properly limited to the intent behind creating a statute—not what imaginations of activist judicial officials decide for interpretation in a single case.

It’s good to see Dana abandoning liberal-tarianism on this issue. The Californian Ideology is antagonistic to morality and the antithesis of our Constitution.

FWIW, Rohrabacher's district is adjacent to my congressman's district.

They should have gotten a departmental slap on the wrist, which is the excepted punishment for improper paperwork-filing. Instead they get thrown in jail for a decade.

Even putting them under House Arrest would be better than the isolation they've had to endure.

The judge had no discretion. The sentences were mandated by law. :(

I said in #5 here that reassignment was IMO appropriate. To another spot ;) These guys need to be freed.

Prosecutorial misconduct can be determined by a judge I think.

Where does "judicial activism" come into play here? If anything, precisely the opposite happened. The District Court judge applied the law and the Appeals Court upheld the application.

You should argue that the judges involved here are taking a stand against legislative complacency (which leads to judicial activism).

Commute their sentences. Would be a nice Christmas present. They don’t deserve to be in solitary confinement or service a sentence that is more severe than the criminal illegal alien they were trying to arrest.
