No. If you're drunk and there's an accident it is YOUR fault. You should NOT have been on the road to begin with. Second, if you rear-end someone, unless they are going in reverse, 99% of the time it is YOUR fault. If someone swerves into your lane worst case should be that you get run off the road.

Drunk driving is a crime, agreed, but two people who end up in an accident while both committed illegalities to get them there have still both contributed to the cause.
