Judge's daughter sues driver she ran into during crash

Convicted last year of intoxication manslaughter for the death of her boyfriend, the 21-year-old daughter of a state district judge is suing the truck driver she ran into during a drunken driving crash.

Elizabeth Shelton, the daughter of juvenile judge Pat Shelton, is accusing truck driver Lance Bennett of negligence in the Oct. 23, 2007, wreck that killed her boyfriend Matthew McNiece.

Bennett was driving the box truck that Shelton rear-ended on the Southwest Freeway near Kirby around 2 a.m.

Shelton had a blood alcohol concentration more than three times the legal limit, two tests showed. She was sentenced to eight years' probation and had to serve four months in jail.

Shelton, her family and the family of the boyfriend who was killed are suing for $20,000 for the destruction of the Lexus SUV she was driving and an undetermined amount for mental anguish, pain and suffering.

The only reason I think she is suing is because her father is a judge and there was obvious favoritism in her getting 4 months of probation for intoxication manslaughter. She therefore likely thinks this convoluted lawsuit has a chance. Especially after her dad’s friend went and stole the vehicle data recorder out of her momma’s lexus.

I am thinking of a class action suit against all Lawyers for negligence, and malfeasance resulting in a critical drag on our economy causing unemployment, distress, hardship for the American public, increased medical costs, higher product costs, Political corruption, indigestion, and obesity. Hmmm only 42 words.

I had a patent attorney whose patents were almost unreadable. One sentence was 243 words long.

Reminds me of another judge's daughter, Blair Hornstine, who sued her school district when the district decided she should share a valedictorian-ship with another student.

Hornstine had gamed the system to get herself a slightly higher GPA than the other student. She also -it was discovered later- had committed plagiarism for some newspaper columns she'd written.

Hornstine won in court but was ultimately shamed by having her Harvard admission rescinded. She had to jet off to Europe to St. Andrews to complete her elite education, poor thing.

You know the truck driver is going to have to pay for a lawyer to defend himself against the crap, take time from his life for court appearances etc.

I hope the insurance company fights this. Too often they just settle.

Mine settled rather than defend me. Then they raised my rates.

I don't want to mention any names, but let's just say I wasn't in good hands after all.

Fair is fair, if the guy swerved into her lane then he’s partially liable for his own injuries, her being drunk or not.

No. If you're drunk and there's an accident it is YOUR fault. You should NOT have been on the road to begin with. Second, if you rear-end someone, unless they are going in reverse, 99% of the time it is YOUR fault. If someone swerves into your lane worst case should be that you get run off the road.

That is actually the exception to the rule that that particular company usually goes by. But there are reasons why a particluar claim is settled before trial.
