Just like Mayor Bill White’s drunk driving daughter (no accident) but driving down the road, weaving at 2 in the morning with her lights off. She got off as well I believe.

Drunks shouldn’t be on the road to begin with because it is illegal, also illegal is crossing the lane markings (called failure to obey a traffic control device in some states). Drunk driving is a crime, agreed, but two people who end up in an accident while both committed illegalities to get them there have still both contributed to the cause. Sure, the drunk is MORE at fault, but her responsibility is somewhat mitigated by the contributing acts of the injured. And if he did swerve into her lane he should be apportioned his proper responsibility for the accident, even if its only determined to be 2%.

Does her state have comparative negligence?

Is this a joint and several claim?

She was driving drunk, however that issue is seperate over whether the truck driver was doing something wrong.

Don’t fall for the DBM hype “just because” a judge’s personal life is in the mix.

NEVER trust the MSM.

I was involved in a car out of no where too. My insurance company settled also. I wanted to fight it but they wouldn't. Now not only do I look to traffic to the right before making a turn but I also watch that the car behind me doesn't come up and cut me off.

It is imperative to be a good defensive driver. Keep it up!

I worked in the field for years, and have evaluated many simple and complex cases for companies. Not just auto cases, but it is inevitable to have them because there are so many of them. Sometimes they settled when i didnt want them to, either.

Consider it to be a “business decison” they made and just move on.

Someone commented on the article at their website and said that she only served 4 months probation (in other words, no jail time). Must be nice to have a daddy who is a judge!

Well there were several strange things about it. Who knows? I didn't even get a ticket for 24 hours but as you say you have to move on.

A few years later though I encountered a scary situation. I was pulling out of an apartment lot and I looked and the car behind me was over to the right about two feet behind me. I stopped and pulled forward and saw him come up several more feet. So we just played chicken awhile. Finally I moved forward and just turned left instead. At the same time he gunned it to the right. If I had turned right we would have collided. If it had not been for that first fender bender I probably would not have even noticed the car behind me.

I never trust the BS Media, what I don’t respect even more is a DUI driver trying to claim it was someone else’s fault.

If she wasn’t DUI, she most likely would not have caused this crash.

In CA, DUI drivers are automatically found at fault.
