Court records: Husband shot wife during intruder game

LINCOLN — Twenty-one-year-old Josh Beasley was pretending to clear his home of intruders on Saturday when he fired the shot that killed his 20-year-old wife, Alaina, according to court documents filed today.

The affidavit, based on Beasley’s interview with a Lincoln police detective on the day of the shooting, was released by Lancaster County Attorney Gary Lacey.

Josh Beasley appeared in court this afternoon on a charge of manslaughter for unintentionally causing his wife’s death.

With about10 friends and family members in the courtroom, Lancaster County Judge James Foster released Beasley without bail. Beasley had turned himself into police this morning.

In an interview with the World-Herald, Beasley earlier said he accidentally shot his wife while cleaning his shotgun.

I absolutely agree. I used the term accident meaning ‘as opposed to intentional’. From a legal perspective, he absolutely is criminally responsible for her death and it was a negligent, reckless act. But in my opinion he no more meant to cause her death than if he had been driving 120 MPH ‘pretending’ to be racing and killed her in a wreck.

Stupid. But you’re are right, stupidity or lack of intent does not absolve negligence.

Because terrified people OFTEN say stupid things at moments like that. You see, they hear that some people want to turn every accident into a homicide.

Him saying he was cleaning wasn’t smart, but it doesn’t make it intentional murder,,(except on CSI Miami)

Ask any cop. People often lie when the truth would clear them. Fear makes people act stupidly, especially 21 year old who probably havent had a thing like that ever happen in his life.

But, see, he could have followed all those 4 rules. It sounds pretty darned intentional to me. There is surely the possibility that it was.

Doesn't read whether pump or semi-auto, but both would have a safety? Was he expecting a "click" from from his shotgun? What was this click supposed to add to his game? Beside prison, this guy needs to be spaded?

Why do you feel the need to go out of the way to defend these actions?

To me, a lie, is a red flag, not “something to be expected”

Yeah,, actually innocent people do change their story. And the do it every day, and for hundreds of reasons. I know all cops are homicidal maniacs who should all be arrested, but ask any cop and he’s guaranteed to have a story or two, or twenty.

And fear and shock are two of them.

This is helpful background info. While I agree that changing his story makes the individual look culpable, OTOH it should be possible to put together what other facts are known and come up with a most likely scenario. If the parents of the girl feel like it was an accident, that’s gotta be worth something. In many other cases of spousal murder(OJ for one, Brad Cooper for another) the parents feel very differently.

Yeah,, the shooting school culture changed “Accidental discharge”, into “Negligent Discharge”. Sorta like illegal alien turned into undocumented immigrant. Still talking about the same thing, but just started using a different word. Like the way “Commandos” became “Operators”. My mom was an Operator back in the 40s. Used to say “Number please” and connect your call.

PC Lingo sometimes invades our side too.

There is no such thing as an accidental discharge.

A negligent discharge is caused by either ignorance or carelessness.

The person can be considered ignorant, if they have not been trained.

They are careless, if they disregard their training.

Always keep the gun pointed in a safe direction

Always keep your finger off the trigger until ready to shoot

Always keep the gun unloaded until ready to use

The story I read said that they went shooting together earlier in the day and the shotgun was not ejecting properly. He worked on it when they got home and set it against the wall without properly clearing. Then, later picked the gun up thinking it would be unloaded.

Why? Well,,Because i murdered my wife and tricked the cops myself! Ha!
What kind of question is that? How about because i have personally seen enough elsewhere to make me feel this is a tragedy. And because *some people* like to pontificate about how they are sure a person who loved his wife of 3 months actually wanted her dead.

Even her own parents don’t think that. The better question is who YOU are going out of your way to lynch him.

Seeing that picture makes me sick. His story sounds like bullsh*t to me. Even if it isn't, I'd have a hard time not “accidentally” putting one in his chest if that were my daughter.

Accidents are caused by ignorance or carelessness. See, the concept still works. If ND works for you better that AD, im happy for you.

Wonder if ill pass any auto accidents, oops, i mean “auto neglingences” on the way home. Its just a word.

Ping! Right in line with my suspicions about people who post photos of themselves on the Internet pointing guns at a camera. And exactly the sort of people I wouldn't want teaching my children, or teaching anybody else's children on my dime.

I've been following this story on the Omaha radio station KFAB since it happened. From some of the background stories about the couple it seems like they were both gun enthusiasts, but not very mature about it. Apparently they were part of a group that would post photos of themselves posing with their guns, pointing them at the camera (unknown if it was on a timer or an actual person holding it taking the picture), and they would blog about the various plans and methods they devised and practiced should they ever have to face an armed intruder in their home.
