Dear Friend,

Despite our victory in passing Proposition 8, traditional marriage is under assault in California. Even after winning a historic victory and passing by a 600,000 voter margin, Prop 8 has been abandoned by many of our elected officials, including those who are sworn to uphold it. Rest assured, however, that our committee will continue to defend Prop 8 and traditional marriage with all of our energies. Here is an update on recent activities:

The California Supreme Court has scheduled a hearing for March 5 to determine if Prop 8 was a validly enacted amendment to the constitution or if it somehow violates the law. All of our legal briefs have been filed with the Court. The ProtectMarriage.com committee is now the ONLY organization battling as a party in the lawsuit to uphold Prop 8. Attorney General Jerry Brown, whose oath of office requires him to defend the People’s right to amend our constitution, has instead decided to oppose Prop 8. While agreeing with us on some points, he’s advancing a novel legal theory that even though Prop 8 was a validly enacted amendment to the constitution, it should nevertheless be thrown out because it supposedly conflicts with the “inalienable” right to liberty of same-sex couples. Not only that, but over forty outside groups (civil rights activists, legal groups, labor unions, bar associations, etc.), represented by literally hundreds of lawyers, also filed legal briefs urging the Supreme Court to overturn the people’s vote for Proposition 8.

Fortunately, we have assembled a top legal team to defend Prop 8. In fact, Kenneth W. Starr is our lead attorney in the Supreme Court.  Mr. Starr, a former Solicitor General of the United States and a former Judge on the United States Court of Appeals, will argue the case at the upcoming hearing on behalf of ProtectMarrige.com - Yes on 8 and the official proponents of Prop 8.

With Ken Starr’s leadership and some early financial support from folks like you, our team of attorneys worked diligently through December and January, researching and drafting legal briefs in response to our opponents’ lawsuits.  It is no overstatement to say that virtually the entire burden of defending Prop 8 and the principle of traditional marriage has fallen on our shoulders. Our opponents have the benefit of taxpayer-paid legal counsel and free access to some of the biggest law firms in the state. We must rely on the generosity of our supporters.

Our attorneys are working hard to prepare for the oral arguments before the Court. They will let the Court know that the Attorney General’s position essentially asks the Court to declare a constitutional revolution. In fact, the Attorney General is arguing that the people are powerless to amend their constitution to overturn judicial interpretations of constitutional principles. ProtectMarriage.com enjoyed the support of over 75,000 individual contributors. Some contributed as little as $5 while others contributed over $1 million. All told, we raised nearly $40 million – an incredible outpouring of support from supporters of traditional marriage in California and across the country. Even still, our opponents raised $3 million more than we did. The fact that we prevailed despite being outspent is a tribute to our campaign and the dedication of our many supporters.

We also are continuing to litigate to protect the privacy of donors to our just concluded campaign. Unfortunately, too many of our supporters have been subjected to harassing calls, emails and other retaliation for supporting Proposition 8. There is clearly an organized effort underway to contact our donors and attempt to silence them from supporting our efforts. Some of our opponents, for example, have put many of our donors’ information on the Internet using Google mapping technology, displaying the location of contributors of as little as $100. (see www.eightmaps.com) For this reason, we are mounting litigation in the federal courts to protect our donors from further disclosure. We expect this litigation to take some time, and likely will not be successful until it is in the federal courts of appeal. However, if you have personally suffered any type of harassment or retaliation in the past few weeks (since January 31) as a result of your contribution to our campaign, please contact us at info@protectmarriage.com. The more that we can document incidents of retaliation, particularly incidents stemming from the outrageous use of Google Maps by our opponents or recent harassment since our campaign reports were filed on January 31, the stronger our case will be.

Finally, as if challenging the validity of Prop 8 in court and harassing hundreds of our supporters were not enough, the opponents of Prop 8 are asking the Legislature to pass Senate Resolution 7 (Leno) and Assembly Resolution 5 (Ammiano) declaring that Prop 8 is invalid. These resolutions have no legal effect, but are intended to send a message to the Supreme Court that a majority of legislators believe Prop 8 should be tossed out. Please act to oppose these resolutions!

SR 7 will be heard in the Senate Judiciary Committee next Tuesday, February 17. Please contact members of the Senate Judiciary Committee to express your opposition to SR 7. Those members are: Senator Ellen Corbett (D-Alameda) (Chair), Senator Tom Harman (R–Orange County) (Vice-Chair) Senator Dean Florez, (D–Central Valley), Senator Mark Leno (D–San Francisco – he is the author of SR 7) and Senator Mimi Walters (R–Orange County).  As a reminder, Proposition 8 passed overwhelmingly in Orange County and the Central Valley and failed in Alameda and San Francisco. AR 5 will also be heard in the Assembly Judiciary Committee next Tuesday, February 17. Please contact members of the Assembly Judiciary Committee to express your opposition to AR 5. They are: Assemblyman Mike Feuer (D–Los Angeles) (Chair), Assemblyman Van Tran (R–Orange County) (Vice Chair), Assembly Member Julia Brownley (D-Los Angeles), Assemblywoman Noreen Evans (D–Napa),  Assemblyman Dave Jones (D–Sacramento),  Assemblyman Steve Knight (R–Antelope Valley), Assemblyman Paul Krekorian (D–Los Angeles),  Assemblyman Ted Lieu (D–Torrance),  Assemblyman Bill Monning (D–Monterey), and Assemblyman Jim Nielsen (R–Gerber/Tehama County). As a reminder, Proposition 8 passed in Los Angeles County, Orange County, Sacramento County and Tehama County, and failed in Monterey County and Napa County. EXTENSION OF REMARKS OF HON. A. S. HERLONG, JR. OF FLORIDA

IN THE HOUSE OF REPRESENTATIVES

Thursday, January 10, 1963

Mr. HERLONG. Mr. Speaker, Mrs. Patricia Nordman of De Land, Fla., is an ardent and articulate opponent of communism, and until recently published the De Land Courier, which she dedicated to the purpose of alerting the public to the dangers of communism in America.

At Mrs. Nordman’s request, I include in the RECORD, under unanimous consent, the following “Current Communist Goals,” which she identifies as an excerpt from “The Naked Communist,” by Cleon Skousen:

CURRENT COMMUNIST GOALS

1. U.S. acceptance of coexistence as the only alternative to atomic war.

2. U.S. willingness to capitulate in preference to engaging in atomic war.

3. Develop the illusion that total disarmament [by] the United States would be a demonstration of moral strength.

4. Permit free trade between all nations regardless of Communist affiliation and regardless of whether or not items could be used for war.

5. Extension of long-term loans to Russia and Soviet satellites.

6. Provide American aid to all nations regardless of Communist domination.

7. Grant recognition of Red China. Admission of Red China to the U.N.

8. Set up East and West Germany as separate states in spite of Khrushchev’s promise in 1955 to settle the German question by free elections under supervision of the U.N.

9. Prolong the conferences to ban atomic tests because the United States has agreed to suspend tests as long as negotiations are in progress.

10. Allow all Soviet satellites individual representation in the U.N.

11. Promote the U.N. as the only hope for mankind. If its charter is rewritten, demand that it be set up as a one-world government with its own independent armed forces. (Some Communist leaders believe the world can be taken over as easily by the U.N. as by Moscow. Sometimes these two centers compete with each other as they are now doing in the Congo.)

12. Resist any attempt to outlaw the Communist Party.

13. Do away with all loyalty oaths.

14. Continue giving Russia access to the U.S. Patent Office.

15. Capture one or both of the political parties in the United States.

16. Use technical decisions of the courts to weaken basic American institutions by claiming their activities violate civil rights.

17. Get control of the schools. Use them as transmission belts for socialism and current Communist propaganda. Soften the curriculum. Get control of teachers’ associations. Put the party line in textbooks.

18. Gain control of all student newspapers.

19. Use student riots to foment public protests against programs or organizations which are under Communist attack.

20. Infiltrate the press. Get control of book-review assignments, editorial writing, policymaking positions.

21. Gain control of key positions in radio, TV, and motion pictures.

22. Continue discrediting American culture by degrading all forms of artistic expression. An American Communist cell was told to “eliminate all good sculpture from parks and buildings, substitute shapeless, awkward and meaningless forms.”

23. Control art critics and directors of art museums. “Our plan is to promote ugliness, repulsive, meaningless art.”

24. Eliminate all laws governing obscenity by calling them “censorship” and a violation of free speech and free press.

25. Break down cultural standards of morality by promoting pornography and obscenity in books, magazines, motion pictures, radio, and TV.

26. Present homosexuality, degeneracy and promiscuity as “normal, natural, healthy.”

27. Infiltrate the churches and replace revealed religion with “social” religion. Discredit the Bible and emphasize the need for intellectual maturity which does not need a “religious crutch.”

28. Eliminate prayer or any phase of religious expression in the schools on the ground that it violates the principle of “separation of church and state.”

29. Discredit the American Constitution by calling it inadequate, old-fashioned, out of step with modern needs, a hindrance to cooperation between nations on a worldwide basis.

30. Discredit the American Founding Fathers. Present them as selfish aristocrats who had no concern for the “common man.”

31. Belittle all forms of American culture and discourage the teaching of American history on the ground that it was only a minor part of the “big picture.” Give more emphasis to Russian history since the Communists took over.

32. Support any socialist movement to give centralized control over any part of the culture—education, social agencies, welfare programs, mental health clinics, etc.

33. Eliminate all laws or procedures which interfere with the operation of the Communist apparatus.

34. Eliminate the House Committee on Un-American Activities.

35. Discredit and eventually dismantle the FBI.

36. Infiltrate and gain control of more unions.

37. Infiltrate and gain control of big business.

38. Transfer some of the powers of arrest from the police to social agencies. Treat all behavioral problems as psychiatric disorders which no one but psychiatrists can understand [or treat].

39. Dominate the psychiatric profession and use mental health laws as a means of gaining coercive control over those who oppose Communist goals.

40. Discredit the family as an institution. Encourage promiscuity and easy divorce.

41. Emphasize the need to raise children away from the negative influence of parents. Attribute prejudices, mental blocks and retarding of children to suppressive influence of parents.

42. Create the impression that violence and insurrection are legitimate aspects of the American tradition; that students and special-interest groups should rise up and use [”]united force[”] to solve economic, political or social problems.

43. Overthrow all colonial governments before native populations are ready for self-government.

44. Internationalize the Panama Canal.

45. Repeal the Connally reservation so the United States cannot prevent the World Court from seizing jurisdiction [over domestic problems. Give the World Court jurisdiction] over nations and individuals alike.

There is plenty of evidence to support that destroying the traditional family will have negative consequences to the individuals and to society. This was demonstrated by the Russian Experiment during late 1930 and early 1940.

The dragging out of the implementation of this clearly correct proposition bodes poorly for its chances, IMO. California is basically corrupt; the court is biding for time to find a way to trash the legitimate outcome of Prop. 8. To me 10 minutes was enough time for the court to decide that Prop 8 clearly and cleanly represents the desire of the people of California. I find the entire situation disgusting to say the least.
