Mr. Davis states the law prohibits: conduct “specifically intended to inflict severe physical or mental pain or suffering.” He then goes on to state that a crime has been committed because waterboarding intentionally inflicts serious physical and mental pain.

My reading of the law is that the intent of the person doing the waterboarding or other activity is the controlling factor in determining whether it is torture, not the activity itself. If waterboarding was done for the primary purpose of inflicting pain or exacting punishment, it could be held to be torture, but if done for the purpose of obtaining needed information or to train your own troops, it would not be torture.

Mr. Davis and others try to focus attention on the activity (waterboarding) and obscure the intent which was perfectly legitimate. They may manufacture a political issue, but I can't see even a liberal judge buying it as a legal argument.

Just as an aside, I once heard of a man who had his arm torn from the socket by a rescue crew trying to pull him from a well that caved in. Under Mr. Davis’ approach, the rescue crew could have been charged with torture.

Political expediency and nothing more. The Dhimmis focus-grouped this “torture” meme and decided it could give them some traction. They know it is just so much exaggerated b.s. Now that Pelosi and other prominent ‘rats are implicated, the Lanny’s of the world are backing off.

Lanny Davis’s picture should be in the dictionary next to “shyster.” Like the sleazebag lawyer he is, Lanny will take any position and make any argument and seems to have no personal moral compass whatsoever.

Getting Cheney to accept a pardon is probably the only way they could pin the stigma of guilt on him. Getting all the information out in the open would show that he did nothing any worse than any number of Dhimmi politicians.

VP Cheney, unlike Davis, is a real man possessing intrinsic integrity. I agree that he would indeed refuse a pardon for a crime he did not commit.

I never thought I would ever forward a Lanny Davis article, but I couldn't resist this piece of “cover-the-dems-butts” tripe. Under the guise of saving the country from a criminal trial charging former VP Cheney and others in the Bush administration with “crimes” resulting from the use of “torture” (his definition) against terrorists/combatants who were not signatories to the mandates of the Geneva Convention, Davis expresses an epiphany he experienced resulting from conversations and emails he received ?!?

No, Lanny, although you are probably one of the few individuals who wouldn't tell the truth, even if water-boarded, only because you have lied so often to protect disgusting, unscrupulous democrats that the truth is foreign to you, I don't buy your argument for a New York second !

First of all, your suggestion that obama pardon VP Cheney and the Bush administration is a red herring. History would forever note that they were guilty of criminal conduct that required a pardon. Secondly, it would put the matter to rest and allow pelosi’s slanderous allegations about the CIA, her continued assertion that she was not briefed about water-boarding prior to the use of that interrogation method and her criminal charge that the CIA lied to Congress also be “pardoned” and allowed to stand, unsubstantiated and uninvestigated. The latter is the true reason Davis, democrats and the media have backed off on the euphemistic “truth hearings” because they know if they go after the Bush administration on this issue, there are culpable democrats who will be held accountable as well.

Lanny, you are so transparent. Perhaps the only transparency in the democrat party is the translucency shown when one of their members attempts to feign graciousness toward a member or members of the Republican Party.

This column is nothing more than damage control necessitated by an incompetent Congressional majority leader who out of animus toward the Bush administration, lied about her own conduct and accused our foreign intelligence agency personnel of criminal activity in regard to use of approved enhanced interrogation methods and the hierarchy of that agency of the crime of lying to Congress regarding the use of those methods.

Save your lame attempts to appear magnanimous for those less politically astute, Lanny..........let the indictments begin; let the investigation run its course; let CIA briefing documents and sworn testimony settle this issue in the manner the citizens of our nation and those under the cloud of unsubstantiated allegations deserve. Bring it on, Lanny !
