EPA fugitive who shot at officers expected to change plea

A Utah fugitive critically injured March 10 during a shoot-out with law enforcement officers in a Marathon trailer park is expected to avoid a trial by pleading guilty today.

Larkin Baggett, 54, formerly of Salt Lake City, was shot in the neck and buttocks after he allegedly pointed an assault rifle at a Monroe County Sheriff's Office deputy and three U.S. Environmental Protection Agency agents.

Baggett was the first man shot by EPA officers in that organization's history.

A change of plea hearing is scheduled today in the courtroom of U.S. Judge Michael Moore at the federal courthouse in Key West.

"Such a hearing usually indicates that a defendant has expressed to the court an intent to plead guilty," said Alicia Valle, spokeswoman for the U.S. Attorney's Office. "However, a defendant can always change his or her mind and proceed to trial."

Valle declined to discuss whether a plea agreement was negotiated with Baggett.

Baggett faces three charges of assault on a federal officer, assault on a person assisting a federal officer and illegal possession of firearms by a felon.

Prosecutors are moving to permanently keep the weapons seized from Baggett's trailer, which included two AR-15 assault rifles, a .308-caliber assault rifle and a pistol that shoots .223 cartridges. It's unclear whether prosecutors also want to seize his property, boat and vehicle.

Baggett was wanted on an EPA warrant for not appearing in court in 2008 on charges of illegally treating and disposing of hazardous waste in Salt Lake City, and illegally discharging acidic chemical waste into the sewer system.

Do you know why he has a felony conviction?

He didn't show in Salt lake City when the EPA charged him for letting soap suds from his truck wash run down the drain

Reminds me of Alice's Restaurant, except that Officer Obey didn't shoot Arlo Guthry for littering

On September 19, 2007, Baggett, owner/operator of Chemical Consultants, Inc. of North Salt Lake, Utah, was indicted in the District of Utah, Salt Lake City, Utah, on four felony counts of violating the federal Resource Conservation and Recovery Act (RCRA) Title 42 Section 6928(d)(2)(A) and two felony counts of federal Clean Water Act Title 33 Section 1319(c)(2)(A).

Chemical Consultants, Inc. was a company that mixes and sells chemical products for use in various industries and was a large quantity generator of hazardous waste. Chemical Consultants, Inc. is alleged to have dumped, without a permit, hazardous waste on to a gravel-covered portion of property leased to his business in 2003 and 2005.

He is also alleged to have dumped chemical wastes into the sanitary sewer in 2004 and 2005 which caused a total of 22 pass-through events at the South Davis Sewer District in Davis County, Utah.

It is alleged that he disposed of waste from sulfuric acids, hydrofluoric and hydrochloric acids that he used to produce products his company sold.

Baggett was arrested on the above charges on September 20, 2007, by federal EPA-CID special agents and the Utah Attorney General’s Office agents.

He was subsequently released from federal custody with conditions pending his trial.

On April 22, 2008, a federal arrest warrant was issued for Baggett for violating the conditions of his release pending his trial.

His trial was scheduled to begin on June 2, 2008. Baggett was taken into Federal custody on March 13, 2009 in Florida.

On April 16 2009, Baggett was charged by a federal Grand Jury in Miami with assaulting law enforcement officers and illegally possessing eight firearms while he was a fugitive from the District of Utah on an environmental crimes prosecution.

You missed the first story

This was a raid under the cover of darkness by the EPA and the County's Keys-stoned Cops

One of the local yokels made some noise up against the trailer and the guy in this tiny trailer picked up his rifle

The rest is the stuff of Randy Wever nightmares

Okay, at first, I thought that said “pollster”, and although it’s a noble gesture, of course, I was wondering why EPA enforcement agents would need to do it.

His business name was "Chemical Consultants." Sound like a little more than a simple truck wash.

Yea, very little more ... he packaged and sold his own brand of cleaner at the truck wash

But what's the difference? He was a polluter and they needed 10 armed guys to flush him out of his trailer

do you know this guy? why are you so quick to believe his version?

Don't know him just know what has been printed in the bait wrapper and the EPA story says he ran a truck wash and they weren't happy with the suds running into the sewer system so they closed him down and then charged him and threatened huge fines

basically they bankrupted him and he ran

And yet my water utility, every time it rains hard (you know we now get about 5-6 ‘100 year’ storms each year) they dump hundreds of millions of gallons of sewage into the lake - never a peep from the media or the EPA because it’s government doing the dumping.

They went apopleptic here when one contractor guy was filmed pushing a piece of concrete into a river here (he was told to do it by his company, and the place along the river is LINED with concrete). Never hear anything negative from the MSM about the gargantuan sewer dumps the local govt does all the time. In fact one of the sewer overflows is within a few blocks of where the piece of concrete was pushed in.

it was soap and what ever else they use at a truck wash to get the gunk off the vehicle

It probably carries dissolved oil and grime and they nailed him for it

This guy was not General Electric burying PCBs in Love canal and then building a housing development and a kiddie park on the site

He was running a truck wash and he packaged and sold 'truck wash' on site

Sure sounds like a small businessman who is still in an EPA nightmare
