How Judge Carter Herded Lawyers 6/2008 ( The judge who ruled on Obama's eligibility today )

U.S. District Court Judge David O. Carter had a scheduling dilemma while managing the pre-trial stages of the government’s prosecution of several alleged members of the notorious Florencia 13 street gang in South Central Los Angeles and Inglewood.

He had 16 defense lawyers plus federal prosecutors — most of whom were also handling other cases in other courthouses — on the case pending before him in the Ronald Reagan Federal Courthouse in Santa Ana.

And Carter, a former state prosecutor and Superior Court judge, knows that getting lawyers together is like herding cats.

Making things a little more difficult for Carter was the fact that one of the defense lawyers – Rob Harley – was in the midst of a lengthy death penalty trial before Orange County Superior Court Judge Richard King. A lawyer just can’t miss a session in a death penalty trial.

But Carter also needed to get the federal case moving.

So he scheduled a rare Saturday court session last week to handle pre-trial motions. He told all the lawyers and their clients to be there and to be ready. Federal judges can do that.

“We started at 8 a.m. and we finished at 10 p.m.,” said Carter. “The air conditioning went out at 5 p.m. We got a lot done between 5:30 an 10 p.m.”

It was either a Saturday session, or conduct night court, Carter said.

“We got it all done,” he said. “We probably saved a week’s worth of court time and a lot of money.”

Remember the judge int he Florida escapade during the aftermath of election 2000? He was so heroic, just doing his duty to the oath he took, and democrats hated him for it!

You bet I remember him, I think I watched every bit of that and he did a great job. He knew the law and ran his courtroom well.

If he’s the one I’m thinking of, he was an Infantry officer with 1/9 and I met him at a funeral down that way about 11 years ago, a friend who was with 1/9 during Operation Buffalo in 1967...

This is the judge who worked the Anna Nicole Smith inheritance battle back in 2002.
He’s had some high profile cases.

Roger that. It was another David that died, one we called Beetle (as in Baily)... And the church was FULL of Marines... many, MANY of us... 1998, it was. I stayed on base at El Toro, the last time I was there before they closed it down...
