An unlicensed driver who struck and killed a 72-year-old Newton woman in a hit-and-run collision in Morristown in December was sentenced yesterday to three years of probation and fined $500.
The Dec. 13 incident occurred around 6:30 p.m. when Andy Maguino, who was driving a delivery car for a local pizzeria, hit Alice Myers as she was walking across Mount Kemble Avenue near Doughty Street, authorities said. Myers died several hours later at Morristown Memorial Hospital.
Much to the dismay of Myers' family, Maguino, a 30-year-old native of Peru who authorities say is in this county illegally, did not face any jail time under a plea deal with the Morris County Prosecutor's Office.

If the family chose to, would they have grounds for a civil suit against the driver? The employer?
FWIW, I’d go after the employer. Heaven knows the local, state, and/or Feds won’t.

Funny you should say FWIW. It’s not worth much, because those are NJ laws, and they only apply to those of us who are here legally. I’ve learned the hard way, illegals are exempt from the laws in NJ. They’re a protected class.
There was a case of an illegal in Ohio who did not have a DL. The state said they could not charge him with manslaughter because he didn't have DL. I believe he was drunk and killed two members of a family.
